AB820,1,4 An Act to amend 29.336 (2) (b) and 29.336 (2) (c); and to create 29.336 (2) (d), 29.336 (2) (e) and 29.336 (2m) of the statutes; relating to: feeding of deer in counties where domestic or wild animals have been confirmed to be positive for chronic wasting disease and granting rule-making authority.

Analysis by the Legislative Reference Bureau

Under current law, the Department of Natural Resources (DNR) must prohibit by rule the feeding of deer to attract them in or from the wild in any county that is in a chronic wasting disease (CWD) control zone designated by DNR, in any county where any animal has been confirmed, after December 31, 1997, to have CWD or bovine tuberculosis and in any county that is within a ten-mile radius of the known location of an animal that has been confirmed, after December 31, 1997, to have either of these diseases. This bill changes this time frame for confirmation of CWD from any time after December 31, 1997, to confirmation within the last 5 years. It does not affect the time frame for confirmation of bovine tuberculosis.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB820, s. 1 Section 1. 29.336 (2) (b) of the statutes is amended to read:

AB820,2,3 29.336 (2) (b) A county in which a positive test for chronic wasting disease or bovine tuberculosis has been confirmed in any captive or free-roaming domestic or wild animal after December 31, 1997.

AB820, s. 2 Section 2. 29.336 (2) (c) of the statutes is amended to read:

AB820,2,8 29.336 (2) (c) A county in which the county or a portion of the county is within a 10-mile radius of the known location of a captive or free-roaming domestic or wild animal that has been tested and confirmed to be positive for chronic wasting disease or bovine tuberculosis after December 31, 1997.

AB820, s. 3 Section 3. 29.336 (2) (d) of the statutes is created to read:

AB820,2,11 29.336 (2) (d) A county in which a positive test for chronic wasting disease has been confirmed in any captive or free-roaming domestic or wild animal.

AB820, s. 4 Section 4. 29.336 (2) (e) of the statutes is created to read:

AB820,2,15 29.336 (2) (e) A county in which the county or a portion of the county is within a 10-mile radius of the known location of a captive or free-roaming domestic or wild animal that has been tested and confirmed to be positive for chronic wasting disease.

AB820, s. 5 Section 5. 29.336 (2m) of the statutes is created to read:

AB820,2,19 29.336 (2m) The rules promulgated under sub. (2) (d) and (e) shall prohibit feeding deer only in those counties that meet the criteria under those rules within the previous five years.
