Under current law, a person may not issue a check if he or she intends that it
not be paid. A person who violates this prohibition is guilty of a misdemeanor or a
felony, depending on the face value of the check or checks involved. This prohibition,
however, does not apply to a postdated check or a check given for something
previously received (except a payroll check).
This bill eliminates the exception in the worthless check statute for postdated
checks and checks given for past consideration.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
