AB928,1,7 1An Act to amend 457.03 (2), 457.11 (title), 457.11 (1) (intro.), 457.11 (1) (a),
2457.11 (1) (c), 457.11 (1) (d), 457.11 (2), 457.13 (title), 457.13 (1) (intro.), 457.13
3(1) (a), 457.13 (1) (d), 457.13 (2), 457.14 (title), 457.14 (2) and 457.20 (2) of the
4statutes; relating to: references to certificates granted by the Marriage and
5Family Therapy, Professional Counseling, and Social Work Examining Board
6and eligibility requirements for training certificates for marriage and family
7therapists and professional counselors.

Under 2001 Wisconsin Act 80, the Marriage and Family Therapy, Professional
Counseling, and Social Work Examining Board (board) grants "licenses" to marriage
and family therapists, professional counselors, and clinical social workers. Under
former law, the board granted "certificates" to these professionals. However, under
the act, as under former law, the board grants "certificates" to other types of social
workers.
This bill changes certain references to "certificates" granted by the board so
that they refer instead to "licenses" and, as a result, makes the references consistent
with the changes made by 2001 Wisconsin Act 80.
The bill also makes changes to the requirements that apply to training
certificates granted for marriage and family therapists and professional counselors.

Under current law, a person is eligible for such a certificate if he or she is employed
full-time, or has an offer of employment, as a marriage and family therapist or
professional counselor in a supervised practice. A person is also eligible if the board
finds that the person will receive training and supervision that is equivalent to such
a supervised practice. As noted above, the bill refers to training "licenses," rather
than training "certificates." In addition, the bill eliminates the requirements that
a person have full-time employment, or an offer of full-time employment, to be
eligible for a training license. Instead, under the bill, a person must be in a position,
or have an offer for a position, as a marriage and family therapist or professional
counselor in a supervised practice. As under current law, a person is also eligible if
the board finds that the person will receive training and supervision that is
equivalent to a position in such a supervised practice. In addition, the bill allows the
board to renew a training license at its discretion. Under current law, a training
certificate may not be renewed. Finally, the bill allows the marriage and family
therapist section of the board to grant a marriage and family therapist training
license to a person who holds an appropriate graduate degree or who is enrolled or
who will be enrolled in a training institute or degree program that is approved by the
board or by a national accreditation commission. Under current law, the marriage
and family therapist section may grant a therapist training license to a person who
has completed his or her postgraduate training.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB928,2,92 457.03 (2) Upon the advice of the social worker section, marriage and family
3therapist section, and professional counselor section, promulgate rules establishing
4a code of ethics to govern the professional conduct of certificate holders and licensees.
5The rules shall specify the services included within the practice of social work,
6advanced practice social work, or independent social work that an individual who is
7certified under this chapter as a social worker, advanced practice social worker, or
8independent social worker may perform and the degree of supervision, if any,
9required to perform those services.

13American Association for Marriage and Family Therapy or by the marriage and
14family therapist section, or holds a graduate degree in a mental health field approved
15by the marriage and family therapist section and is enrolled or will be enrolled in a
16master's or doctoral degree program in marriage and family therapy accredited by
17the commission on accreditation for marriage and family therapy education
.

20therapist section that he or she is employed full-time, or has an offer of full-time
21employment
in a position, or has an offer for a position, as a marriage and family
22therapist in a supervised marriage and family therapist practice or is in a position,
23or has an offer for a position,
in which the applicant will, in the opinion of the
24marriage and family therapist section, receive training and supervision equivalent

1to the training and supervision received in a full-time supervised marriage and
2family therapist practice.
AB928, s. 7 3Section 7. 457.11 (2) of the statutes is amended to read:
AB928,4,114 457.11 (2) A marriage and family therapist training certificate license is valid
5for 24 48 months or until the date on which the holder of the certificate ceases to be
6employed in a position specified in sub. (1) (d), whichever occurs first, and may not
7be renewed by at the discretion of the marriage and family therapist section. A
8marriage and family therapist training certificate license authorizes the holder to
9use any title specified in s. 457.04 (5) and to practice marriage and family therapy
10within the scope of his or her training or supervision during the period in which the
11certificate license is valid.
