AB937,1,3 1An Act to repeal 118.43 (5); to renumber and amend 118.43 (7); and to create
2118.43 (7) (b) and (c) of the statutes; relating to: the evaluation of the Student
3Achievement Guarantee in Education Program and making an appropriation.
Analysis by the Legislative Reference Bureau
Under current law, a school district may enter into a five-year, renewable
student achievement guarantee (SAGE) contract with the Department of Public
Instruction (DPI) to reduce class size to 15 pupils in grades kindergarten to three in
exchange for receiving state aid equal to $2,000 for each low-income pupil enrolled
in grades eligible for SAGE funding. Current law directs DPI to arrange for an
evaluation of SAGE and allocates $250,000 for that purpose.
Beginning in the 2006-07 fiscal year, this bill allocates $125,000 annually for
the evaluation. The bill also requires that the evaluation include a longitudinal
study that documents and records the continuing academic achievement of identified
individual pupils who are enrolled in schools covered by SAGE contracts and the
academic achievement of identified individual pupils who are not enrolled in such
schools. The person conducting the study must identify at least 500 individual pupils
enrolled in grades kindergarten to three in each category and collect data that
indicates the performance of the pupils on standardized tests in grades three, grade
four, grade eight, and grade ten. The statewide assessments must be used for this
purpose. The person must also collect data on the pupils who leave the study,
including whether the pupils have transferred to a different school or school district
or are no longer attending school, and on the pupils who graduate from high school.

The person performing the evaluation annually must report the most recent data to
DPI and to appropriate committees of the legislature. The report must include a list
of those schools that have terminated SAGE contracts since the previous report and
delineate the reasons for each termination.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB937, s. 2 2Section 2. 118.43 (7) of the statutes is renumbered 118.43 (7) (a) and amended
3to read:
AB937,2,74 118.43 (7) (a) Evaluation. Beginning in the 1996-97 school year, the
5department shall arrange for an evaluation of the program under this section and
6shall allocate from the appropriation under s. 20.255 (2) (cu) $250,000 $125,000
7annually
for that purpose.
AB937, s. 3 8Section 3. 118.43 (7) (b) and (c) of the statutes are created to read:
AB937,2,189 118.43 (7) (b) The person conducting the study under par. (a) shall randomly
10identify at least 500 pupils enrolled in grades kindergarten to 3 who are enrolled in
11schools covered by contracts under this section and at least 500 pupils enrolled in
12grades kindergarten to 3 who are not enrolled in such schools. Annually, the person
13shall collect data on the pupils that indicates their academic performance in grade
143, in grade 4, in grade 8, and in grade 10. The person shall use the scores on tests
15administered under ss. 118.30 and 121.02 (1) (r) for this purpose, and may use other
16data as well. The person shall also collect data on the pupils who leave the study,
17including whether the pupils have transferred to a different school or school district
18or are no longer attending school, and on the pupils who graduate from high school.
AB937,3,319 (c) The person performing the evaluation under par. (a) annually shall submit
20a report containing the most recent data collected under par. (b) to the department

1and to the appropriate standing committees of the legislature under s. 13.172 (3).

AB937,3,95 (1) In the schedule under section 20.005 (3) of the statutes for the appropriation
6to the department of public instruction under section 20.255 (2) (cu) of the statutes,
7as affected by the acts of 2005, the dollar amount is decreased by $125,000 for fiscal
8year 2006-07 to decrease funding for the purpose for which the appropriation is
9made.
AB937, s. 5 10Section 5. Effective dates. This act takes effect on the day after publication,
11except as follows:

13effect on July 1, 2006.
