AJR92,1,3 1To create section 27 of article I of the constitution; relating to: the right of the
2residents of Wisconsin to preventive and primary health care (first
3consideration).
Analysis by the Legislative Reference Bureau
This proposed constitutional amendment, proposed to the 2005 legislature on
first consideration, provides that the right of the residents of Wisconsin to preventive
and primary health care shall be ensured by the state as one of its necessary duties,
and the legislature shall provide by law for the provision of such health care.
A proposed constitutional amendment requires adoption by two successive
legislatures, and ratification by the people, before it can become effective.
AJR92,1,4 4Resolved by the assembly, the senate concurring, That:
AJR92, s. 1 5Section 1. Section 27 of article I of the constitution is created to read:
AJR92,1,106 [Article I] Section 27. The health and well-being of the people having been
7determined to be fundamental to the enjoyment of the rights of life, liberty, and the
8pursuit of happiness, the right of the residents of Wisconsin to preventive and
9primary health care shall be ensured by the state as one of its necessary duties, and
10the legislature shall provide by law for the provision of such health care.

1Section 2. Numbering of new provision. The new section 27 of article I of
2the constitution created in this joint resolution shall be designated by the next higher
3open whole section number in that article if, before the ratification by the people of
4the amendment proposed in this joint resolution, any other ratified amendment has
5created a section 27 of article I of the constitution of this state. If one or more joint
6resolutions create a section 27 of article I simultaneously with the ratification by the
7people of the amendment proposed in this joint resolution, the sections created shall
8be numbered and placed in a sequence so that the sections created by the joint
9resolution having the lowest enrolled joint resolution number have the numbers
10designated in that joint resolution and the sections created by the other joint
11resolutions have numbers that are in the same ascending order as are the numbers
12of the enrolled joint resolutions creating the sections.
AJR92,2,15 13Be it further resolved, That this proposed amendment be referred to the
14legislature to be chosen at the next general election and that it be published for 3
15months previous to the time of holding such election.
