SB339,1,2 1An Act to create 118.019 (6) of the statutes; relating to: providing notice of
2abstinence only education.

This bill requires each school board that receives federal funding to provide a
program of abstinence only education (the teaching of abstaining from sexual
activity outside marriage) or that elects to provide such a program to notify each
pupil's parent or guardian of these facts. The notice must also state that abstinence
only education does not teach pupils how to prevent pregnancy or sexually
transmitted diseases, other than by remaining abstinent, and that a pupil, at the
request of his or her parent or guardian, may be excused from abstinence only
education and may not be subject to discipline or academic penalty as a result.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB339, s. 1 3Section 1. 118.019 (6) of the statutes is created to read:
SB339,1,64 118.019 (6) Notice about abstinence only education. (a) In this subsection,
5"abstinence only education" has the meaning given for "abstinence education" in 42
6USC 710
(b) (2).

1(b) Each school board that receives federal funding to provide a program of
2abstinence only education or that elects to provide such a program, shall, at the
3beginning of each school year, send a written notice to each pupil's parent or guardian
4that contains all of the following statements:
SB339,2,55 1. The pupil is receiving abstinence only education.
SB339,2,86 2. Abstinence only education does not teach pupils how to prevent pregnancy
7and sexually transmitted infections, such as human immunodeficiency virus and
8acquired immunodeficiency syndrome, other than by remaining abstinent.
SB339,2,109 3. At the written request of the parent or guardian under sub. (4), the school
10board shall excuse the pupil from instruction in abstinence only education.
SB339,2,1211 (c) A pupil excused under par. (b) 3. is not subject to discipline or academic
12penalty.
