SB394,1,2 1An Act to amend 448.03 (1) (a); and to create 446.01 (1m), 446.02 (2) (am) and
2448.015 (1g) of the statutes; relating to: electromyography.

This bill provides that only a physician or a chiropractic neurologist licensed in
this state may perform a needle electromyography. A "needle electromyography" is
the recording for diagnostic purposes of electrical activity generated by a muscle
using a needle electrode.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB394, s. 1 3Section 1. 446.01 (1m) of the statutes is created to read:
SB394,1,54 446.01 (1m) "Needle electromyography" means the recording for diagnostic
5purposes of electrical activity generated by a muscle using a needle electrode.
SB394, s. 2 6Section 2. 446.02 (2) (am) of the statutes is created to read:
SB394,2,57 446.02 (2) (am) The examining board shall grant a certificate to perform a
8needle electromyography to a person who holds a license to practice chiropractic and

1who submits an application for the certificate to the department on a form provided
2by the department, accompanied by satisfactory evidence that he or she has the
3education, training, and experience necessary to be eligible for, or has been admitted
4to, diplomate status by the American Board of Chiropractic Neurology, or an
5equivalent national certification agency, and pays the fee specified in s. 440.05 (1).
SB394, s. 3 6Section 3. 448.015 (1g) of the statutes is created to read:

8purposes of electrical activity generated by a muscle using a needle electrode.
SB394, s. 4 9Section 4. 448.03 (1) (a) of the statutes is amended to read:
SB394,2,1310 448.03 (1) License required to practice. (a) No Except as provided in s. 446.02
11(2) (am), no
person may practice medicine and surgery, or perform a needle
12electromyography,
or attempt to do so or make a representation as authorized to do
13so, without a license to practice medicine and surgery granted by the board.
