1An Act to amend 29.741 of the statutes;
relating to: removal of aquatic plants

Analysis by the Legislative Reference Bureau
Under current law, the Department of Natural Resources (DNR) is required to
manage the aquatic plants in the state by controlling or removing some plants,
including those that are invasive and cause significant adverse changes to an aquatic
environment. In addition, DNR has authority to issue permits for other persons to
control or remove certain aquatic plants. Current law also prohibits any person from
taking aquatic plants from the waters of this state. This bill removes the conflict
between these two provisions by allowing persons to remove aquatic plants if they
are doing so under the DNR aquatic plant management program.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Law Revision Committee prefatory note: This bill is a remedial legislation
proposal, requested by the Department of Natural Resources and introduced by the Law
Revision Committee under s. 13.83 (1) (c) 4., stats. After careful consideration of the
various provisions of the bill, the Law Revision Committee has determined that this bill
makes minor substantive changes in the statutes, and that these changes are desirable
as a matter of public policy.

No Except as provided in s. 23.24,
3no person may, from the public waters of this state, take, remove, sell, or transport
4any duck potato,
any wild celery, or any other plant or plant product except wild rice,
5that is native to these waters and that is commonly known to furnish food for game
6birds.
