AB105,1,3 1An Act to amend 16.75 (1) (a) 1. and 16.82 (intro.); and to create 16.75 (10r) and
216.82 (9) of the statutes; relating to: telephone company inquiry services by
3state agencies, authorities, and vendors.

This bill prohibits the Department of Administration (DOA), any agency to
which DOA delegates purchasing authority, or any authorized legislative and
judicial officer from entering into any contract or order to purchase materials,
supplies, equipment, or services with an entity unless the entity maintains at least
one telephone line that is staffed during its regular business hours by an individual
who can respond to business inquiries.
The bill also directs DOA to ensure that each state agency and authority
maintains at least one telephone line that is staffed during the regular business
hours of the agency or authority by an individual who can respond to general
inquiries relating to the functions of the agency and to refer callers to appropriate
subunits and employees of the agency or authority.
Currently, there is no similar requirement.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 16.75 (1) (a) 1. of the statutes is amended to read:
AB105,2,102 16.75 (1) (a) 1. All orders awarded or contracts made by the department for all
3materials, supplies, equipment, and contractual services to be provided to any
4agency, except as otherwise provided in par. (c) and subs. (2), (2g), (2m), (3m), (3t),
5(6), (7), (8), (9), and (10m), and (10r) and ss. 16.73 (4) (a), 16.751, 16.754, 50.05 (7) (f),
6153.05 (2m) (a), 287.15 (7), and 301.265, shall be awarded to the lowest responsible
7bidder, taking into consideration life cycle cost estimates under sub. (1m), when
8appropriate, the location of the agency, the quantities of the articles to be supplied,
9their conformity with the specifications, and the purposes for which they are
10required and the date of delivery.
AB105, s. 2 11Section 2. 16.75 (10r) of the statutes is created to read:
AB105,2,1812 16.75 (10r) The department, any other designated purchasing agent under s.
1316.71 (1), any agency making purchases under s. 16.74, or any authority may not
14enter into any contract or order for the purchase of materials, supplies, equipment,
15or contractual services with a person unless the person maintains at least one
16telephone line that is staffed during its regular business hours by an individual who
17is able to respond to general inquires relating to its regular business functions and
18who is able to refer callers to appropriate subunits and employees.
AB105, s. 3 19Section 3. 16.82 (intro.) of the statutes is amended to read:

21addition to other powers vested in and duties assigned to the department of
22administration, it and its duly authorized representatives:

AB105,3,324 16.82 (9) Shall ensure that each agency and authority, as defined in s. 16.70,
25maintains at least one telephone line that is staffed during the regular business

1hours of the agency or authority by an individual who is able to respond to general
2inquiries relating to the functions of the agency and to refer callers to appropriate
3subunits and employees of the agency or authority.
AB105, s. 5 4Section 5. Effective date.
AB105,3,65 (1) This act takes effect on the first day of the 3rd month beginning after
6publication.
