AB140,1,2 1An Act to create 236.10 (1) (d) and 236.13 (2r) of the statutes; relating to: school
2board approval of subdivision plats.

Under current law, before a subdivision plat may be recorded, the city, village,
or town in which the subdivision lies must approve the plat. The city, village, or town
may condition approval of a plat upon such conditions as compliance with its
ordinances and comprehensive plan.
This bill requires the school board of each school district in which the
subdivision lies to approve the subdivision plat, as well. A school board may
condition plat approval upon the requirements that the subdivision not pose a safety
hazard for the busing of pupils, not increase school district transportation costs, not
reduce state school aids received by the school district, or not otherwise adversely
affect the school district's budget.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB140, s. 1 3Section 1. 236.10 (1) (d) of the statutes is created to read:
AB140,1,54 236.10 (1) (d) The school board of each school district in which the subdivision
5lies.

1Section 2. 236.13 (2r) of the statutes is created to read:
AB140,2,32 236.13 (2r) As a further condition of approval, a school board may require one
3or more of the following:
AB140,2,54 (a) That the subdivision not pose a safety hazard for pupils being transported
5by bus.
AB140,2,66 (b) That the subdivision not increase school district transportation costs.
AB140,2,87 (c) That the subdivision not reduce state school aids received by the school
8district.
AB140,2,109 (d) That the subdivision not otherwise adversely affect the school district's
10budget.
AB140, s. 3 11Section 3. Initial applicability.
AB140,2,1412 (1) This act first applies to preliminary plats or, in cases in which no
13preliminary plats are submitted, final plats that are submitted for approval on the
14effective date of this subsection.
