AB172,1,2 1An Act to create 134.435 of the statutes; relating to: acquisitions of mobile
2telephone service providers.

Under this bill, if a mobile telephone service provider acquires another mobile
telephone service provider, the acquiring provider may not require a customer of the
acquired provider to obtain new telephone equipment in order to continue to receive
service or to increase the monthly minutes of service provided to the customer. Also,
the acquiring provider must permit a customer of the acquired provider to terminate
any contractual obligation to the acquiring provider if the customer gives notice
within 60 days after the date on which the customer first receives a bill from the
acquiring provider.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB172,1,5 4134.435 Mobile telephone service providers; acquisitions. (1) In this
5section:
AB172,1,66 (a) "Commercial mobile service" has the meaning given in 47 USC 332 (d).

1(b) "Mobile telephone service provider" means a person that is authorized by
2the federal communications commission to provide commercial mobile service.
AB172,2,4 3(2) If a mobile telephone service provider acquires another mobile telephone
4service provider, all of the following apply:
AB172,2,75 (a) The acquiring mobile telephone service provider may not require a customer
6of the acquired mobile telephone service provider to obtain new telephone equipment
7in order to do any of the following:
AB172,2,88 1. Continue to receive commercial mobile service.
AB172,2,109 2. Increase the monthly minutes of commercial mobile service provided to the
10customer.
AB172,2,1611 (b) The acquiring mobile telephone service provider shall permit a customer of
12the acquired mobile telephone service provider to terminate any contractual
13obligation to the acquiring mobile telephone service provider without penalty, if the
14customer gives notice to the acquiring mobile telephone service provider within 60
15days after the date on which the customer first receives a bill from the acquiring
16mobile telephone service provider.
