AB645,1,3 1An Act to create 946.405 of the statutes; relating to: providing a penalty for
2failure of a person to disclose his or her name upon the demand of a law
3enforcement officer during an investigatory stop.
Analysis by the Legislative Reference Bureau
Under current law, a law enforcement officer may stop and question a person
whom the officer reasonably suspects is committing, is about to commit, or has
committed a crime, and may demand that the person disclose his or her name. This
bill provides that any person who is the subject of such a stop and fails to disclose his
or her name in response to the officer's demand, if the demand is reasonably related
to the circumstances justifying the stop, is subject to a forfeiture not to exceed $500.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB645,2,2 5946.405 Failure to provide name during investigatory stop. Any person
6who is stopped by a law enforcement officer under s. 968.24 and fails to disclose his
7or her name in response to the officer's demand for the person's name, if the demand

1is reasonably related to the circumstances justifying the stop, is subject to a Class
2C forfeiture.
