AB813,1,3 1An Act to create 100.287 of the statutes; relating to: regulating the provision
2of certain plastic bags to customers of retailers of consumer goods and granting
3rule-making authority.

This bill prohibits a person who is engaged in the retail sale of goods for
personal, family, or household use from providing a plastic bag for a customer's
purchases unless the bag is compostable or reusable. This prohibition takes effect
three years after the bill's publication date.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB813, s. 1 4Section 1. 100.287 of the statutes is created to read:
AB813,1,8 5100.287 Provision of bags by retailers. No person who is engaged in the
6retail sale of goods intended for personal, household, or family use may provide a
7plastic bag to a customer for the purpose of carrying the customer's purchases unless
8the plastic bag is any of the following:
AB813,2,1
1(1) A compostable plastic bag, as defined by the department by rule.
AB813,2,3 2(2) Intended for reuse, if the bag is made of plastic that is not less than 2.25
3thousandths of an inch in thickness.
AB813, s. 2 4Section 2. Effective date.
AB813,2,65 (1) This act takes effect on the first day of the 36th month beginning after
6publication.
