AB248,1,3 1An Act to amend 125.32 (6) (a); and to create 125.32 (6) (c) and 125.68 (13) of
2the statutes; relating to: the possession and consumption of alcohol beverages
3on retail licensed premises in a park in a 1st class city.
Analysis by the Legislative Reference Bureau
Under current law, a person may not possess, on premises covered by a retail
or wholesale fermented malt beverages (beer) license or permit, any alcohol
beverages not authorized by law for sale on the premises.
Under this bill, a licensee may, if the licensed premises are in a park within a
1st class city, permit customers to bring in and consume on the licensed premises beer
or intoxicating liquor that was purchased elsewhere.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB248, s. 1 4Section 1. 125.32 (6) (a) of the statutes is amended to read:
AB248,1,85 125.32 (6) (a) Except as provided in s. 125.33 (2) (o) or (12) or 125.70, and
6subject to par. (c),
no person may possess on the premises covered by a retail or
7wholesale fermented malt beverages license or permit any alcohol beverages not
8authorized by law for sale on the premises.

1Section 2. 125.32 (6) (c) of the statutes is created to read:
AB248,2,62 125.32 (6) (c) Paragraph (a) does not prohibit a licensee under s. 125.26 from
3allowing, if the licensed premises are located in a public park within a 1st class city,
4a person who does not hold a license or permit under this chapter to possess and
5consume on the licensed premises fermented malt beverages that were not
6purchased from the licensee.
AB248, s. 3 7Section 3. 125.68 (13) of the statutes is created to read:
AB248,2,128 125.68 (13) Intoxicating liquor not purchased on retail premises in a park.
9No provision of this chapter prohibits a licensee under s. 125.51 (3) from allowing,
10if the licensed premises are located in a public park within a 1st class city, a person
11who does not hold a license or permit under this chapter to possess and consume on
12the licensed premises intoxicating liquor that was not purchased from the licensee.
