AB293,1,3 1An Act to amend 441.06 (3) and 441.10 (3) (b); and to create 441.001 (5) and
2441.065 of the statutes; relating to: collection of workforce data on registered
3nurse and licensed practical nurse license renewal forms.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Joint Legislative Council prefatory note: This bill was prepared for the Joint
Legislative Council's Special Committee on Building Wisconsin's Workforce.
This bill requires that a registered nurse (R.N.) or licensed practical nurse (L.P.N.)
submit workforce data to the Board of Nursing as part of the renewal process for a license
as an R.N. or L.P.N. Under the bill, "workforce data" includes information relating to
gender, race and ethnicity, employment, and education.
This bill also requires that the Department of Regulation and Licensing (DRL) and
the Department of Workforce Development (DWD) enter into a memorandum of
understanding regarding the specific workforce data to be collected.
AB293, s. 1 4Section 1. 441.001 (5) of the statutes is created to read:

1441.001 (5) Workforce data. "Workforce data" includes information relating
2to gender, race and ethnicity, employment, and education.
Note: This Section creates a definition of "workforce data".
AB293, s. 2 3Section 2. 441.06 (3) of the statutes, as affected by 2007 Wisconsin Act 20, is
4amended to read:
AB293,2,95 441.06 (3) A registered nurse practicing for compensation shall, on or before
6the applicable renewal date specified under s. 440.08 (2) (a), submit to the board on
7furnished forms a statement giving name, residence, workforce data, and other facts
8that the board requires, with the applicable renewal fee determined by the
9department under s. 440.03 (9) (a).
Note: Current law requires an individual to hold and biennially renew a license
as an R.N. in order to practice professional nursing in Wisconsin. To renew a license as
an R.N., an R.N. must submit to the Board of Nursing a statement giving name,
residence, and other facts that the board requires. This Section requires an R.N. to
submit workforce data in that statement.
AB293, s. 3 10Section 3. 441.065 of the statutes is created to read:
AB293,2,14 11441.065 Workforce data. The department shall enter into a memorandum
12of understanding with the department of workforce development regarding specific
13workforce data to be collected on forms furnished by the department under ss. 441.06
14(3) and 441.10 (3) (b).
Note: This Section directs DRL and DWD to cooperate in determining specific
workforce data to be collected.
AB293, s. 4 15Section 4. 441.10 (3) (b) of the statutes, as affected by 2007 Wisconsin Act 20,
16is amended to read:
AB293,3,417 441.10 (3) (b) On or before the applicable renewal date specified under s. 440.08
18(2) (a), a licensed practical nurse practicing for compensation shall submit to the
19board, on forms furnished by the department, an application for license renewal,
20together with a statement giving name, residence, nature and extent of practice as

1a licensed practical nurse during the prior year and prior unreported years,
2workforce data, and other facts bearing upon current competency that the board
3requires, accompanied by the applicable license renewal fee determined by the
4department under s. 440.03 (9) (a).
Note: Current law requires an individual to hold and biennially renew a license
as an L.P.N. in order to hold himself or herself out as an L.P.N. To renew a license as an
L.P.N., an L.P.N. must submit to the Board of Nursing a statement giving name,
residence, and other facts that the board requires. This Section requires an L.P.N. to
submit workforce data in that statement.
AB293, s. 5 5Section 5. Effective date.
AB293,3,76 (1) This act takes effect on July 2, 2009, or on the first day of the 3rd month
7beginning after publication, whichever is later.
