AB577,1,4 An Act to renumber 29.228 (2); to amend 29.563 (3) (intro.); and to create 29.219 (2) (d), 29.219 (2m), 29.228 (2) (b), 29.228 (4m), 29.563 (3) (a) 4m., 29.563 (3) (b) 5m. and 29.563 (3r) of the statutes; relating to: requiring the Department of Natural Resources to issue one-day fishing licenses.

Analysis by the Legislative Reference Bureau

Under current law, with certain exceptions including an exception for residents under the age of 16, no person may fish in this state unless the person has a valid approval that authorizes fishing. The Department of Natural Resources (DNR) issues various fishing licenses including resident and nonresident annual fishing licenses, two-day sports fishing licenses for both residents and nonresidents, 15-day fishing licenses for nonresidents, and four-day fishing licenses for nonresidents. This bill requires DNR to also issue one-day fishing licenses to residents and nonresidents. The bill also provides that a person who holds a one-day fishing license may pay a reduced fee for an annual license that is issued during the same year for which the one-day license is valid.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB577, s. 1 Section 1. 29.219 (2) (d) of the statutes is created to read:

AB577,2,5 29.219 (2) (d) A resident annual fishing license issued to any resident who holds a one-day fishing license under sub. (2m) that is valid during the same year for which the resident applies for a resident annual fishing license shall be issued at the reduced fee under s. 29.563 (3r).

AB577, s. 2 Section 2. 29.219 (2m) of the statutes is created to read:

AB577,2,9 29.219 (2m) One-day fishing license. The department shall issue a resident one-day fishing license, subject to s. 29.024, to any resident who applies for this license.

AB577, s. 3 Section 3. 29.228 (2) of the statutes is renumbered 29.228 (2) (a).

AB577, s. 4 Section 4. 29.228 (2) (b) of the statutes is created to read:

AB577,2,15 29.228 (2) (b) A nonresident annual fishing license issued to any nonresident who holds a one-day fishing license under sub. (4m) that is valid during the same year for which the resident applies for a resident annual fishing license shall be issued at the reduced fee under s. 29.563 (3r).

AB577, s. 5 Section 5. 29.228 (4m) of the statutes is created to read:

AB577,2,19 29.228 (4m) One-day fishing license. The department shall issue a nonresident one-day fishing license, subject to s. 29.024, to any nonresident who applies for this license.

AB577, s. 6 Section 6. 29.563 (3) (intro.) of the statutes is amended to read:

AB577,2,22 29.563 (3) Fishing approvals. (intro.) Except as provided in sub. subs. (3m) and (3r), the fees for fishing approvals are as follows:

AB577, s. 7 Section 7. 29.563 (3) (a) 4m. of the statutes is created to read:

AB577,2,24 29.563 (3) (a) 4m. One-day fishing: $7.25.

AB577, s. 8 Section 8. 29.563 (3) (b) 5m. of the statutes is created to read:

AB577,3,1 29.563 (3) (b) 5m. One-day: $9.25.

AB577, s. 9 Section 9. 29.563 (3r) of the statutes is created to read:

AB577,3,9 29.563 (3r) Reduced fees for certain annual fishing licenses. (a) Instead of the fee charged under sub. (3) (a) 1., the department shall charge a reduced fee for a resident annual fishing license if the applicant holds a resident one-day fishing license under s. 29.219 (2m) that is valid during the same year for which the annual license is issued. The reduced fee shall be an amount equal to the difference between the fee for the resident annual fishing license under sub. (3) (a) 1. and the fee for a resident one-day fishing license under sub. (3) (a) 4m.

AB577,3,16 (b) Instead of the fee charged under sub. (3) (b) 1., the department shall charge a reduced fee for a nonresident annual fishing license if the applicant holds a nonresident one-day fishing license under s. 29.228 (4m) that is valid during the same year for which the annual license is issued. The reduced fee shall be an amount equal to the difference between the fee for the nonresident annual fishing license under sub. (3) (b) 1. and the fee for a nonresident one-day fishing license under sub. (3) (a) 5m.

AB577, s. 10 Section 10. Effective date.

AB577,3,19 (1) This act takes effect on April 1, 2010, or the day after publication, whichever is later.
