AB733,1,3 An Act to amend 281.61 (5) and 281.61 (10) of the statutes; relating to: the deadlines, for applying for assistance and closing loans under the Safe Drinking Water Loan Program.

Analysis by the Legislative Reference Bureau

Currently, under the Safe Drinking Water Loan Program, this state provides loans to local governmental units for projects for the construction or modification of public water systems. Current law requires a local governmental unit to submit an application for a loan under the program no later than the April 30 preceding the beginning of the fiscal year in which the local governmental unit wishes to receive the loan.

This bill changes the application deadline for a loan from the Safe Drinking Water Loan Program from April 30 to June 30 and provides that a local governmental unit that applies after June 30 may receive a loan if funds are available after funding is allocated for loans for all of the eligible projects for which applications were submitted by June 30.

Under current law, if an applicant for a loan under the Safe Drinking Water Loan Program does not close on the loan before April 30 of the year after the year in which funding is allocated to the applicant, the funding is released. This bill changes the deadline for closing from April 30 to June 30.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB733, s. 1 Section 1. 281.61 (5) of the statutes is amended to read:

AB733,2,14 281.61 (5) Application. After the department approves a local governmental unit's engineering report submitted under sub. (4), the local governmental unit shall submit an application for safe drinking water financial assistance to the department. The applicant shall submit the application on or before the April June 30 preceding the beginning of the fiscal year in which the applicant wishes to receive the financial assistance, except that if funds are available in a fiscal year after funding has been allocated under sub. (8) for all approved applications submitted before the June 30 preceding that fiscal year, the department of administration may allocate funding for approved applications submitted after June 30. The application shall be in the form and include the information required by the department and the department of administration and shall include plans and specifications that are approvable by the department under this section. An applicant may not submit more than one application per project per year.

AB733, s. 2 Section 2. 281.61 (10) of the statutes is amended to read:

AB733,2,19 281.61 (10) Deadline for closing. If funding is allocated to a project under sub. (8) for a loan and the loan is not closed before April June 30 of the year following the year in which funding is allocated, the department of administration shall release the funding allocated to the project.
