AB708,1,3 1An Act to create 758.20 of the statutes; relating to: prohibiting the display on
2the consolidated court automation programs of records of municipal ordinance
3violations committed by persons seventeen years of age.

Under current law, the director of state courts maintains a system, known as
the Consolidated Court Automation Programs (CCAP), that contains information
about family, civil, and criminal cases and municipal ordinance violations filed in the
courts in this state. The information on CCAP is available for free on an Internet Web
site. CCAP allows a user to enter a person's name into a search function on the Web
site and retrieve information about every case involving the person.
Under current law, records of delinquency or of alleged criminal or municipal
ordinance violations involving a person under the age of 17 are confidential and not
available for public review on CCAP. However, records of criminal charges and
charges involving a municipal ordinance violation are available for public review on
CCAP if the person charged is 17 years of age or is an adult. Generally, records of
non-traffic municipal ordinance violations are viewable on CCAP for five years.
Under this bill, records involving a municipal ordinance violation alleged
against or committed by a person who is 17 years of age may not be displayed on
CCAP.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB708, s. 1 1Section 1. 758.20 of the statutes is created to read:
AB708,2,7 2758.20 Consolidated court automation programs. (1) In this section,
3"Wisconsin Circuit Court Access Internet Web site" means the Web site of the
4consolidated court automation programs, which is the statewide electronic circuit
5court case management system established under s. 758.19 (4) and maintained by
6the director of state courts, that provides information regarding the cases heard in
7the circuit courts.
AB708,2,12 8(2) The director of state courts may not list or otherwise display on the
9Wisconsin Circuit Court Access Internet Web site any action involving a municipal
10ordinance violation committed or alleged to have been committed by a person who,
11at the time of the alleged violation, had attained 17 years of age but who had not
12attained 18 years of age.
AB708, s. 1 13Section 1. Initial applicability.
AB708,2,1514 (1) This act first applies to a municipal ordinance violation that occurs on the
15effective date of this subsection.
