AB713,1,2 1An Act to create 5.05 (16) and 39.55 of the statutes; relating to: disclosure of
2research funding by employees of certain institutions of higher education.

This bill requires every employee of an institution of the University of
Wisconsin System or a private institution of higher education that receives state
funds to disclose any research regarding a drug, device, product, or governmental
program or policy that is conducted if the research is conducted using any state
resources. The employee must annually disclose the amount and percentage of
funding for the research that is provided by state sources, by federal sources, and by
private sources on a form developed by the Governmental Accountability Board
(board). The employee must send the completed form to the board. The bill requires
the board to post a summary of each disclosure on a searchable Internet Web site.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB713, s. 1 3Section 1. 5.05 (16) of the statutes is created to read:
AB713,2,94 5.05 (16) Research funding sources form. (a) The board shall develop and
5make available to all employees of institutions of higher education without charge

1the disclosure of research funding sources form that must be completed as required
2under s. 39.55. The form shall require the employee to identify each state, federal,
3and private source of funding for the research conducted by the employee and the
4amount and percentage of funding from each state, federal, and private source. The
5form shall require the employee to disclose anything of value that the employee or
6a member of his or her family has received in the past 5 years, or has an expectation
7of receiving, from any person that has an interest in the drug, device, product, or
8governmental program or policy that is the subject of the research. The form shall
9be in 16 point type.
AB713,2,1110 (b) The form shall identify the manner in which the form shall be submitted
11to the board.
AB713,2,1412 (c) The board shall post a summary of each disclosure form submitted to the
13board on a searchable Internet Web site maintained by the board along with a link
14to each completed form.
AB713, s. 2 15Section 2. 39.55 of the statutes is created to read:
AB713,2,16 1639.55 Disclosure of research funding sources. (1) In this section:
AB713,2,2017 (a) "Institution of higher education" means an institution within the University
18of Wisconsin System or a private educational institution located in this state that
19awards a bachelor's or higher degree or provides a program that is acceptable toward
20such a degree and that receives funds from the state government.
AB713,2,2321 (b) "Research" means any diligent and systematic inquiry regarding a drug,
22device, product, or governmental program or policy that is conducted using any state
23resources.
AB713,3,4 24(2) Every employee of an institution of higher education who conducts any
25research shall annually complete the disclosure of research funding sources form

1described in sub. (4) to disclose the amount and percentage of funding for the
2research that is provided by state sources, the amount and percentage of funding for
3the research that is provided by federal sources, and the amount and percentage of
4funding for the research that is provided by private sources.
AB713,3,7 5(3) Every disclosure of research funding sources form completed under sub. (2)
6shall be submitted annually to the government accountability board in the manner
7described on the form.
AB713,3,10 8(4) The disclosure of research funding sources form shall be created by the
9government accountability board under s. 5.05 (16) and shall be available without
10charge to every employee of an institution of higher education.
AB713,3,11 11(5) Any individual who violates this section is guilty of a Class I felony.
AB713, s. 3 12Section 3. Initial applicability.
AB713,3,1413 (1) The treatment of section 39.55 of the statutes first applies to research
14conducted on the effective date of this subsection.
AB713, s. 4 15Section 4. Effective date.
AB713,3,1616 (1) This act takes effect on the first day of the 6th month after publication.
