Explanation of Proposal
This constitutional amendment, proposed to the 2011 legislature on first
consideration, eliminates the restriction that only a marriage between one man and
one woman shall be valid or recognized as a marriage in this state and the provision
that a legal status identical or substantially similar to that of marriage for
unmarried individuals shall not be valid or recognized in this state.
A proposed constitutional amendment requires adoption by two successive
legislatures, and ratification by the people, before it can become effective.
AJR138,1,3 3Resolved by the assembly, the senate concurring, That:
AJR138, s. 1 4Section 1. Section 13 of article XIII of the constitution is amended so as in
5effect to repeal said section:
AJR138,2,26 [Article XIII] Section 13 Only a marriage between one man and one woman
7shall be valid or recognized as a marriage in this state. A legal status identical or

1substantially similar to that of marriage for unmarried individuals shall not be valid
2or recognized in this state.
AJR138,2,5 3Be it further resolved, That this proposed amendment be referred to the
4legislature to be chosen at the next general election and that it be published for three
5months previous to the time of holding such election.
