SB262,1,3 1An Act to create 30.12 (1n) of the statutes; relating to: a permit exemption for
2the placement of a pier containing a floating toilet facility in the St. Croix
3National Scenic Riverway.

Current law generally prohibits any person from depositing any material or
placing any structure upon the bed of a navigable water without a permit issued by
the Department of Natural Resources. Under current law, certain deposits and
structures are exempt from this permit requirement. For example, a riparian owner
(a person who owns land adjacent to a navigable water) may place a pier on the bed
of a navigable water if the pier meets certain size and location requirements.
This bill creates another exemption to the general permit requirement. Under
this bill, no permit is required for the placement of a pier in a federally administered
area of the St. Croix National Scenic Riverway if the pier is placed by the National
Park Service, the pier contains a floating toilet facility, and the floating toilet facility
meets specifications approved by the National Park Service.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB262, s. 1 4Section 1. 30.12 (1n) of the statutes is created to read:

130.12 (1n) Floating toilet facilities. (a) In this subsection, "national park
2service" means the national park service, federal department of the interior.
SB262,2,43 (b) The placement of a pier that meets all of the following requirements is
4exempt from the permit requirements under this section:
SB262,2,65 1. The pier contains a floating toilet facility that meets technical specifications
6approved by the national park service for floating toilet facilities.
SB262,2,97 2. The pier is owned and placed by the national park service along a federally
8owned shoreline in a federally administered area of the St. Croix National Scenic
9Riverway.
