SB361,1,6 1An Act to renumber and amend 115.28 (54) (title) and 115.28 (54); to amend
220.255 (2) (cf), 20.255 (2) (ep) and 121.08 (4) (c); and to create 115.363 (1) and
3115.363 (3) of the statutes; relating to: payments to the Second Chance
4Partners for Education and other nonprofit corporations that operate programs
5in which disengaged pupils participate in work-based learning programs while
6earning high school diplomas.
Analysis by the Legislative Reference Bureau
Current law directs the Department of Public Instruction (DPI) to pay to the
Second Chance Partners for Education, Inc. (SCPE), a nonprofit corporation
operating a program in which children at risk participate in apprenticeships while
earning high school diplomas, $4,610 for each pupil participating in the program.
The amount of state aid that a school district is eligible to be paid is reduced by an
amount equal to the amount paid to SCPE for pupils enrolled in the school district.
Under this bill, DPI must pay SCPE, and any other nonprofit corporation
operating a program in which disengaged high school pupils are enrolled in a
work-based learning program, for each pupil participating in the program, the
amount paid per pupil to independent charter schools. The bill requires one-half of
the payment to be made by October 15th and the other half to be made by February
15th. The reduction in state aid to school districts is unchanged.
The bill takes effect on July 1, 2012.

1115.363 (1) In this section:
SB361,3,42 (a) "Disengaged pupil" means a pupil who is a child at risk, as defined in s.
3118.153 (1) (a), or is disinterested in school, struggling academically, or disruptive in
4class.
SB361,3,65 (b) "Work-based learning program" means a program that provides
6occupational training and work-based learning experiences.
SB361, s. 6 7Section 6. 115.363 (3) of the statutes is created to read:
SB361,3,138 115.363 (3) One-half of the payment under sub. (2) shall be based upon the
9number of pupils participating in the program on the 3rd Friday of September of the
10current school year, and one-half of the payment under sub. (2) shall be based upon
11the number of pupils participating in the program on the 2nd Friday of January of
12the current school year. The department shall make the first payment by October
1315th and the second payment by February 15th each year.
SB361, s. 7 14Section 7. 121.08 (4) (c) of the statutes is amended to read:
SB361,3,2115 121.08 (4) (c) The amount of state aid that a school district is eligible to be paid
16from the appropriation under s. 20.255 (2) (ac) shall also be reduced by an amount
17equal to the amount paid to the Second Chance Partnership Partners for Education
18or other nonprofit corporation
under s. 115.28 (54) 115.363 for pupils enrolled in the
19school district. The department shall ensure that the amount of the aid reduction
20lapses to the general fund and that it does not affect the amount determined to be
21received by a school district as state aid under this section for any other purpose.
SB361, s. 8 22Section 8. Effective date.
SB361,3,2323 (1) This act takes effect on July 1, 2012.
