AB291,1,3 1An Act to amend 440.62 (3) (ag) 2., 440.62 (3) (ar) 2., 454.20 (2), 454.23 (2) (d)
2and 454.26 (2); and to create 454.01 (7m) (am) of the statutes; relating to:
3requirements concerning barbering and cosmetology licensure.
Analysis by the Legislative Reference Bureau
This bill makes several changes to the laws governing barbering and
cosmetology in Wisconsin, including the following:
1. Under current law, barbering includes dyeing, tinting, coloring, or bleaching
a person's hair. The bill removes those activities from the scope of the practice of
barbering in Wisconsin.
2. Under current law, a course of instruction in barbering must include at least
1,000 classroom hours, and those classroom hours must be spread out over at least
10 months. The bill eliminates that 10-month requirement.
3. Current law requires that an apprentice in barbering must complete at least
3,712 hours of practical training and 288 classroom hours before the apprentice may
sit for the examination to become a licensed barber. Under the bill, an apprentice in
barbering must complete at least 1,712 hours of practical training and 288 classroom
hours before the apprentice may sit for the examination to become a licensed barber.
4. Under current law, a course of instruction in barbering or in cosmetology may
not exceed eight hours in one day or 48 hours in one week. The bill eliminates that
limitation.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB291,1 1Section 1. 440.62 (3) (ag) 2. of the statutes is amended to read:
AB291,2,52 440.62 (3) (ag) 2. Requires as a prerequisite to graduation completion of a
3course of instruction in barbering of at least 1,000 training hours in not less than 10
4months. The course of instruction may not exceed 8 training hours in any one day
5for any student or 48 hours in any one week for any student

AB291,2 6Section 2. 440.62 (3) (ar) 2. of the statutes is amended to read:
AB291,2,107 440.62 (3) (ar) 2. Requires as a prerequisite to graduation completion of a
8course of instruction in cosmetology of at least 1,800 training hours in not less than
910 months. The course of instruction may not exceed 8 training hours in any one day
10for any student or 48 hours in any one week for any student.
AB291,3 11Section 3. 454.01 (7m) (am) of the statutes is created to read:
AB291,2,1312 454.01 (7m) (am) Dyeing, tinting, coloring, bleaching, or performing similar
13work upon the hair of the head, neck, or face of any person by any means.
AB291,4 14Section 4. 454.20 (2) of the statutes is amended to read:
AB291,2,2015 454.20 (2) "Barbering" means, for compensation, arranging, styling, dressing,
16shampooing, cleansing, curling, dyeing, tinting, coloring, bleaching, waving,
17straightening, cutting, shaving, trimming, relaxing, singeing, or performing similar
18work upon the hair of the head, neck, or face of any person by any means. "Barbering"
19does not include the removal of a person's hair at the root or the application of
20temporary or permanent eyelash extensions to the eyelashes of a person.
AB291,5 21Section 5. 454.23 (2) (d) of the statutes is amended to read:

1454.23 (2) (d) The applicant graduates from a course of instruction in barbering
2of at least 1,000 training hours in barbering in not less than 10 months in a school
3of barbering licensed under s. 440.62 (3) (ag), a school of cosmetology licensed under
4s. 440.62 (3) (ar), or a school that is exempted under s. 440.61 or the applicant
5successfully completes an apprenticeship under s. 454.26.
AB291,6 6Section 6. 454.26 (2) of the statutes is amended to read:
AB291,3,137 454.26 (2) An apprentice in barbering shall receive at least 3,712 1,712 hours
8of practical training in barbering and at least 288 training hours of instruction in
9barbering in a school of barbering or school of cosmetology in order to complete the
10apprenticeship program and be eligible to take the examination for a barber license.
11An apprentice in barbering shall receive training in barbering for a total of at least
1232 hours per week. The training shall be completed in not less than 2 years and not
13more than 4 years.
AB291,7 14Section 7. Initial applicability.
AB291,3,1815 (1) The treatment of section 440.62 (3) (ag) 2. and (ar) 2. of the statutes first
16applies to a license issued by the department of safety and professional services
17under section 440.62 (3) (ag) or (ar) of the statutes on the effective date of this
18subsection.
AB291,3,2119 (2) The treatment of sections 454.23 (2) (d) and 454.26 (2) of the statutes first
20applies to a barber license issued by the department of safety and professional
21services on the effective date of this subsection.
