AB3,1,3 1An Act to renumber and amend 450.19 (1); and to create 450.19 (1) (a) of the
2statutes; relating to: the exclusion of veterinarians from the prescription drug
3monitoring program.
Analysis by the Legislative Reference Bureau
Current law requires the Pharmacy Examining Board (board) to establish a
prescription drug monitoring program (program) upon the board's receipt of certain
federal funds. Once established, the program requires a pharmacist or other
practitioner to generate a record documenting each dispensing of a prescription drug
that is covered by the program, generally certain controlled substances or other
drugs the board identifies as having a substantial potential for abuse. The
pharmacist or practitioner must then deliver that record to the board. Under current
law, a person who is licensed to practice veterinary medicine in Wisconsin is a
practitioner subject to the program.
This bill exempts licensed veterinarians from the requirements of the program.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB3,1 4Section 1. 450.19 (1) of the statutes is renumbered 450.19 (1) (intro.) and
5amended to read:

1450.19 (1) (intro.) In this section, "prescription:
AB3,2,3 2(b) "Prescription drug" means a substance identified in s. 961.16 or 961.18 or
3a drug identified by the board by rule as having a substantial potential for abuse.
AB3,2 4Section 2. 450.19 (1) (a) of the statutes is created to read:
AB3,2,65 450.19 (1) (a) "Practitioner" has the meaning given in s. 450.01 (17) but does
6not include a veterinarian licensed under ch. 453.
AB3,3 7Section 3. Nonstatutory provisions.
AB3,2,118 (1) The pharmacy examining board may not require a veterinarian licensed
9under chapter 453 of the statutes to deliver to the board a record that the
10veterinarian generated in compliance with the program under section 450.19 of the
11statutes before the effective date of this subsection.
