AB505,1,3 1An Act to amend 29.164 (1) (b), 29.164 (1) (c), 29.164 (3) (b) 2. and 29.164 (3) (ci)
2of the statutes; relating to: issuance of wild turkey hunting licenses to
3qualified resident and nonresident landowners.
Analysis by the Legislative Reference Bureau
Under current law, in issuing turkey hunting licenses, the Department of
Natural Resources must use a preference system which gives preferences to
residents if the number of license applicants exceeds the number of wild turkey tags
that are available for a particular season. Under that system, qualified resident
landowners receive first preference in obtaining a wild turkey hunting license and
qualified nonresident landowners receive fourth preference. Under current law, an
applicant is a qualified landowner if the applicant owns at least 50 acres of land in
a single parcel in an established wild turkey hunting zone.
Under the bill, the land may be in more than one parcel but must be located
totally in the same wild turkey hunting zone.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB505,1 4Section 1. 29.164 (1) (b) of the statutes is amended to read:

129.164 (1) (b) "Landowner" means the owner of record of a parcel of land or the
2purchaser of land under a land contract who has the right to occupy and the right to
3use the land.
AB505,2 4Section 2. 29.164 (1) (c) of the statutes is amended to read:
AB505,2,75 29.164 (1) (c) "Operator" means a resident who is residing on a parcel of land
6under a rental agreement, lease, agreement or contract and who is engaged in farm
7activities or other operations on the land.
AB505,3 8Section 3. 29.164 (3) (b) 2. of the statutes is amended to read:
AB505,2,129 29.164 (3) (b) 2. For purposes of subd. 1., a qualified resident landowner is a
10resident who owns at least 50 acres in one parcel of land in an established wild turkey
11hunting zone. If more than one individual is the landowner of a single parcel of the
12land, only one individual may be considered a qualified resident landowner.
AB505,4 13Section 4. 29.164 (3) (ci) of the statutes is amended to read:
AB505,2,2214 29.164 (3) (ci) Fourth preference. The department shall create a 4th preference
15category in issuing wild turkey hunting licenses to applicants who are qualified
16nonresident landowners. For purposes of this paragraph, a qualified nonresident
17landowner is a person who is not a resident and who owns at least 50 acres in one
18parcel
in an established wild turkey hunting zone and who agrees to allow other
19persons to hunt wild turkeys on that land if those persons first obtain permission to
20hunt from the landowner. If more than one individual is the landowner of a single
21parcel of
the land, only one individual may be considered a qualified nonresident
22landowner.

1(1) This act first applies to applications for wild turkey hunting licenses
2submitted on the effective date of this subsection.
