SB294,1,2 1An Act to amend 972.15 (4m) of the statutes; relating to: access to presentence
2investigation report by an assistant attorney general.

Current law provides access to a presentence investigation report to the district
attorney and to the defendant's attorney. This bill provides access to the report to
the assistant attorney general following a conviction for a felony in which the
assistant attorney general has original jurisdiction.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB294,1 3Section 1. 972.15 (4m) of the statutes is amended to read:
SB294,2,44 972.15 (4m) The district attorney and , the defendant's attorney, and, following
5a conviction for a felony in which an assistant attorney general has original
6jurisdiction, the assistant attorney general
are entitled to have and keep a copy of
7the presentence investigation report. If the defendant is not represented by counsel,
8the defendant is entitled to view the presentence investigation report but may not

1keep a copy of the report. A district attorney or , the defendant's attorney, or an
2assistant attorney general
who receives a copy of the report shall keep it confidential.
3A defendant who views the contents of a presentence investigation report shall keep
4the information in the report confidential.
