AB443,1,2 1An Act to amend 751.12 (3) of the statutes; relating to: publication of certain
2proposed rules and changes to existing rules.

This bill allows certain proposed rules or changes to an existing rule to be placed
on an Internet site. Under current law, when the Wisconsin Supreme Court (court)
wishes to consider whether to promulgate a new rule or change an existing rule
regulating pleading, practice, or procedure, it holds a hearing on the new rule or the
change.
Current law requires the court to publish notice of the hearing in a newspaper
for three consecutive weeks prior to, and in the publication of the State Bar of
Wisconsin (Bar) not more than 60 days nor less than 30 days before, the date of
hearing. Current law requires the court to include in its notice the full text of the
proposed rule or the change to an existing rule.
This bill replaces the requirement that the court include the full text of the
proposed rule or the change to the existing rule in a notice published in a newspaper
and in the publication of the Bar, with the requirement that the court must place the
full text on the court's Internet site.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 751.12 (3) of the statutes is amended to read:
AB443,2,92 751.12 (3) Notice of public hearings shall be given by publication of a class 3
3notice, under ch. 985, the expense of the publication to be paid out of the state
4treasury. Notice shall also be given in an official publication of the State Bar of
5Wisconsin, the notice to be published not more than 60 days nor less than 30 days
6before the date of hearing. The State Bar of Wisconsin shall not charge the state
7treasury for publication of this notice. Proposed rules, including changes, if any, in
8existing rules, shall be set forth in full in the notice placed on the Internet site
9maintained by the director of state courts for the supreme court
.
