AB449,1,2 1An Act to amend 121.91 (4) (o) 1. of the statutes; relating to: the school district
2revenue limit adjustment for energy efficiency projects.

This bill limits the school district revenue limit adjustment for projects to
implement energy efficiency measures or to purchase energy efficiency products
(energy efficiency projects) to school districts that adopted a resolution before the
effective date of the bill.
Current law generally limits the total amount of revenue per pupil a school
district may receive from general school aids and property taxes in a school year to
the amount of revenue received per pupil in the previous school year. However, there
are several exceptions to the revenue limit under current law. Once such exception
is for a school district that adopts a resolution to initiate an energy efficiency project.
Under current law, a school district's revenue limit is increased by the amount the
school district spends on the energy efficiency project in a school year, including
amounts spent for debt service on a bond, note, or state trust fund loan used to
finance the energy efficiency project. This bill limits this school district revenue limit
adjustment to school districts that adopted a resolution to initiate an energy
efficiency project before the effective date of the bill.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 121.91 (4) (o) 1. of the statutes is amended to read:
AB449,2,152 121.91 (4) (o) 1. Except as provided in subd. 1m., if a school board adopts a
3resolution to do so before the effective date of this subdivision .... [LRB inserts date],
4the limit otherwise applicable to a school district under sub. (2m) in any school year
5is increased by the amount spent by the school district in that school year on a project
6to implement energy efficiency measures or to purchase energy efficiency products,
7including the payment of debt service on a bond or note issued, or a state trust fund
8loan obtained, to finance the project, if the project results in the avoidance of, or
9reduction in, energy costs or operational costs, the project is governed by a
10performance contract entered into under s. 66.0133, and the bond or note issued or
11state trust fund loan obtained to finance the project is issued for a term not exceeding
1220 years. If a school board issues a bond or note or obtains a state trust fund loan
13to finance a project described in this subdivision, a resolution adopted by a school
14board under this subdivision is valid for each school year in which the school board
15pays debt service on the bond, note, or state trust fund loan.

AB449,2,1817 (1) This act takes effect on January 1, 2016, or the day after publication,
18whichever is later.
