AB703,1,2 1An Act to renumber 86.03 (3); and to create 86.03 (3) (b) of the statutes;
2relating to: planting trees, shrubs, or hedges on the side of certain highways.
Analysis by the Legislative Reference Bureau
Under current law, a person who owns land that adjoins a highway may, with
the approval of the public authority maintaining the highway, plant, cultivate, and
maintain trees, shrubs, or hedges on the side of the highway contiguous to and within
ten feet of that person's land. Under this bill, if the person who owns the land that
adjoins a highway is a town, the town may, with the approval of the public authority
maintaining the highway, authorize another person to plant trees, shrubs, or hedges
on the land.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB703,1 3Section 1. 86.03 (3) of the statutes is renumbered 86.03 (3) (a).
AB703,2 4Section 2. 86.03 (3) (b) of the statutes is created to read:
AB703,2,45 86.03 (3) (b) Notwithstanding par. (a), if the person who owns or occupies the
6land that adjoins a highway is a town, the town may, with the approval of the public

1authority that maintains the highway, authorize another person to plant trees,
2shrubs, or hedges on the land. If the public authority maintaining the highway is
3a county, the town may request approval under this paragraph from the county on
4behalf of the person to be authorized.
