AB810,1,3 1An Act to amend 237.04 (7); and to create 16.848 (2) (i), 16.848 (5), 237.03 (1)
2(f), 237.04 (11) and 237.07 (1) (a) 3. of the statutes; relating to: the Fox River
3Navigational System visitor center.

This bill authorizes the Department of Administration to sell a parcel of land
to the city of Appleton for the purpose of constructing a visitor center for the Fox
River Navigational System and authorizes the Fox River Navigational System
Authority to lease land and construct, operate, and maintain a visitor center on the
land. This bill also requires the authority to establish an escrow account with
moneys sufficient to dispose of the visitor center and terminate any associated lease.
This bill also authorizes the department to trade a parcel of land that is part of the
navigational system, subject to requirements.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB810,1 4Section 1. 16.848 (2) (i) of the statutes is created to read:
AB810,1,65 16.848 (2) (i) Subsection (1) does not apply to property that is traded by the
6department under sub. (5).

1Section 2. 16.848 (5) of the statutes is created to read:
AB810,2,32 16.848 (5) (a) In this subsection, "navigational system" has the meaning given
3in s. 237.01 (5).
AB810,2,64 (b) The department may trade a parcel of land that is part of the navigational
5system for another parcel of land if the parcels are of comparable value and any of
6the following applies:
AB810,2,87 1. The parcel to be received by the department is more suitable to the purposes
8of the navigational system than the parcel to be traded by the department.
AB810,2,99 2. The trade consolidates navigational system land.
AB810,2,1010 3. The trade settles a boundary dispute or encroachment.
AB810,3 11Section 3. 237.03 (1) (f) of the statutes is created to read:
AB810,2,1412 237.03 (1) (f) Establish an escrow account with moneys sufficient to dispose of
13the visitor center authorized under s. 237.04 (11) and to terminate any lease under
14s. 237.04 (7) associated with the visitor center.
AB810,4 15Section 4. 237.04 (7) of the statutes is amended to read:
AB810,2,2216 237.04 (7) Acquire, lease, subject to s. 237.05 (2), and dispose of property as is
17necessary for the rehabilitation, repair, replacement, operation, or maintenance of
18the navigational system or the construction, operation, and maintenance of a
19navigational system visitor center. A lease agreement for the construction,
20operation, and maintenance of a navigational system visitor center shall not be
21subject to building commission approval, notwithstanding any contrary provision of
22law
.
AB810,5 23Section 5. 237.04 (11) of the statutes is created to read:
AB810,3,224 237.04 (11) Construct, operate, and maintain a navigational system visitor
25center. Facilities constructed under this subsection are not required to be

1enumerated or approved by the building commission and are not subject to the
2design, bidding, or construction requirements of subch. V of ch. 16.
AB810,6 3Section 6. 237.07 (1) (a) 3. of the statutes is created to read:
AB810,3,44 237.07 (1) (a) 3. Describes the escrow account required under s. 237.03 (1) (f).
AB810,7 5Section 7. Nonstatutory provisions.
AB810,3,136 (1) Notwithstanding sections 13.488 and 16.848 of the statutes, the
7department of administration may sell a parcel of land located in the city of Appleton
8to the city of Appleton for the purpose of constructing a visitor center for the Fox
9River Navigational System. The sale of a parcel of land under this subsection shall
10not be subject to the requirements of section 13.48 (14) or 16.848 of the statutes. The
11deed transferring title to the land sold under this subsection shall restrict the city
12of Appleton from using the land for any purpose other than the construction,
13operation, and maintenance of the visitor center.
