SB114,1,2 1An Act to amend 814.62 (3) (a) and 814.62 (3) (d) 2. of the statutes; relating to:
2small claims court fee.
Analysis by the Legislative Reference Bureau
Under current law, a person who commences a small claims action in circuit
court must pay a fee of $22. Of that fee, $11.80 is paid to the secretary of
administration to be deposited in the general fund and the balance is retained for use
by the county. The small claims procedure applies to eviction actions and other
actions, including certain civil actions in which the amount claimed does not exceed
$10,000. This bill provides that a person who commences a small claims action in
circuit court must pay a fee of $50; of that fee, $20 is to be paid to the secretary for
deposit into the general fund.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

5a summons or other process in a proceeding not commenced by a summons, the
6plaintiff shall pay to the clerk of court a fee of $22 $50.

1Section 2. 814.62 (3) (d) 2. of the statutes is amended to read:
SB114,2,62 814.62 (3) (d) 2. Of the fees received by the clerk under par. (a), the county
3treasurer shall pay $11.80 $20 to the secretary of administration for deposit in the
4general fund and shall retain the balance for the use of the county. The secretary of
5administration shall credit the $11.80 $20 to the appropriation under s. 20.680 (2)
6(j).
