This bill eliminates a rule promulgated by the Department of Natural
Resources, relating to construction permit requirements for stationary sources that
emit greenhouse gases, which is no longer valid under the Supreme Court's decision
in Utility Air Regulatory Group v. EPA, 573 U.S. ___ (2014).
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

4administrative code are consolidated, renumbered NR 405.07 (9) (a) (intro.) and
5amended to read:
SB144,1,96 NR 405.07 (9) (a) (intro.) Emissions Beginning January 2, 2011, emissions of
7greenhouse gases at a stationary source shall only be subject to regulation under the
8Act as follows: 1. Beginning January 2, 2011, if the stationary source is any of the
9following:

2405.07 (9) (a) 1m.
