SB397,1,3 1An Act to repeal 38.08 (1) (a) 1g.; and to amend 38.08 (1) (a) 1. (intro.), 38.08
2(1) (a) 1r., 38.08 (2m), 38.10 (1) (d) and 38.10 (2) (g) 2. of the statutes; relating
3to:
district board membership for the Milwaukee Area Technical College.
Analysis by the Legislative Reference Bureau
This bill changes the composition of the district board for the Milwaukee Area
Technical College, which, under current law, consists of the following nine members:
five employers, one school district administrator, one elected official, and two
additional members. Under current law, the district boards of all other technical
colleges consist of the following nine members: two employers, two employees, one
school district administrator, one elected official, and three additional members.
Under this bill, the composition of the district board of the Milwaukee Area Technical
College is the same as the other boards under current law.
The bill also adds three members to the appointment committee that appoints
members to the district board for the Milwaukee Area Technical College. Under
current law, the appointment committee consists of the county executive of
Milwaukee County and the chairpersons of the Milwaukee, Ozaukee, and
Washington County boards of supervisors. This bill adds the following three
members to the appointment committee: the mayor of the city of Milwaukee or his
or her designee; the president of the common council of the city of Milwaukee or his
or her designee; and the president of the board of school directors of the city of
Milwaukee or his or her designee. Under current law, three members of the
appointment committee constitute a quorum. Under the bill, four members
constitute a quorum.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB397,1 1Section 1. 38.08 (1) (a) 1. (intro.) of the statutes is amended to read:
SB397,2,42 38.08 (1) (a) 1. (intro.) A district board shall administer the district and, except
3as provided in subd. 1g.,
shall be composed of 9 members who are residents of the
4district, consisting of the following:

SB397,3 7Section 3. 38.08 (1) (a) 1r. of the statutes is amended to read:
SB397,2,118 38.08 (1) (a) 1r. The board shall by rule define "employer" and "employee" for
9the purpose of subd. 1. a. and b. For purposes of subd. 1g. a., "employer" means a
10business entity, as defined in s. 13.62 (5), nonprofit organization that provides health
11care services, credit union, or cooperative association.
SB397,4 12Section 4. 38.08 (2m) of the statutes is amended to read:
SB397,2,1513 38.08 (2m) Any member of a district board serving as an elected official under
14sub. (1) (a) 1. e. or 1g. c. shall cease to be a member upon vacating his or her office
15as an elected official.
SB397,5 16Section 5. 38.10 (1) (d) of the statutes is amended to read:
SB397,3,317 38.10 (1) (d) Notwithstanding pars. (a) to (c), the county executive of
18Milwaukee County and, the chairpersons of the Milwaukee, Ozaukee, and
19Washington County boards of supervisors, the mayor of the city of Milwaukee or his
20or her designee, the president of the common council of the city of Milwaukee or his
21or her designee, and the president of the board of school directors in charge of the

1public schools of the city of Milwaukee or his or her designee
shall constitute the
2appointment committee for the district board governing the Milwaukee area
3technical college.
SB397,6 4Section 6. 38.10 (2) (g) 2. of the statutes is amended to read:
SB397,3,75 38.10 (2) (g) 2. Three Four members shall constitute a quorum for the
6appointment committee for the district board governing the Milwaukee area
7technical college.
SB397,7 8Section 7 . Nonstatutory provisions.
SB397,3,159 (1) Notwithstanding section 38.08 (1) (a) 1. of the statutes, as affected by this
10act, the members of the district board governing the Milwaukee area technical
11college described in section 38.08 (1) (a) 1g. b., c., and d., 2013 stats., shall serve on
12the district board until the expiration of their terms. Notwithstanding section 38.08
13(1) (b) of the statutes, the members of the district board governing the Milwaukee
14area technical college who are appointed to replace the members described in section
1538.08 (1) (a) 1g. a., 2013 stats., shall have terms expiring as follows:

17and one of the members described in section 38.08 (1) (a) 1. c. of the statutes shall
18have terms expiring on June 30, 2017.
SB397,3,2119 (b) One of the members described in section 38.08 (1) (a) 1. a. of the statutes
20and one of the members described in section 38.08 (1) (a) 1. b. of the statutes shall
21have terms expiring on June 30, 2018.
SB397,3,2322 (c) One of the members described in section 38.08 (1) (a) 1. a. of the statutes
23shall have a term expiring on June 30, 2019.
SB397,8 24Section 8. Effective dates. This act takes effect on July 1, 2016, or on the day
25after publication, whichever is later, except as follows:

1(1) The treatment of sections 38.10 (1) (d) and (2) (g) 2. of the statutes and
2Section 7 of this act take effect on the day after publication.
