SB555,1,4 1An Act to amend 321.35 (1) of the statutes; relating to: the mileage
2reimbursement rate for travel expenses of national guard members on state
3active duty (suggested as remedial legislation by the Department of Military

Under one provision in current law, a member of the national guard who is
called into state active duty may receive the same amount of travel expenses as the
federal government pays to an officer or enlisted member of equal rank in the
corresponding branch of the U.S. armed forces. A separate provision in current law
prohibits mileage reimbursement that exceeds the mileage reimbursement rate for
state employees, which may be less than the federal rate.
This bill authorizes mileage reimbursement at the federal rate for a member
of the national guard who is called into state active duty regardless of the applicable
rate for state employees.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

Law Revision Committee prefatory note: This bill is a remedial legislation
proposal, requested by the Department of Military Affairs and introduced by the Law
Revision Committee under s. 13.83 (1) (c) 4. and 5., stats. After careful consideration of
the various provisions of the bill, the Law Revision Committee has determined that this
bill makes minor substantive changes in the statutes, and that these changes are
desirable as a matter of public policy.

SB555,2,52 321.35 (1) Every officer and enlisted person on state active duty in the national
3guard shall receive the base pay, allowances, and, notwithstanding ss. 16.53 (12) (c)
4and (d) and 20.916 (8) and (9), travel expenses of an officer or enlisted person of equal
5rank in the corresponding branch of the U.S. armed forces.
Note: This bill creates an exception for members of the national guard on state
active duty to the prohibition against the Department of Administration approving for
payment certain travel expenses exceeding the auto mileage rates set for state employees
under s. 20.916 (4) (a) and (e), stats.
