SB743,1,3 1An Act to amend 450.02 (3m) (am); and to create 450.02 (3r) of the statutes;
2relating to: waivers and variances from rules issued by the Pharmacy
3Examining Board and authorizations for pilot programs.

This bill authorizes the Pharmacy Examining Board to grant a waiver or
variance from a rule promulgated by the board, or authorize a pilot program, if the
waiver, variance, or pilot program is related to the practice of pharmacy or
prescription verification and the board or its designee determines that the waiver,
variance, or pilot program will improve the safety, quality, or efficiency of the practice
of pharmacy in Wisconsin.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB743,1 4Section 1. 450.02 (3m) (am) of the statutes is amended to read:
SB743,2,25 450.02 (3m) (am) If a member of the board disagrees with a decision made by
6a designee under par. (a) or sub. (3r), the board chairperson shall call a meeting of

1the board as soon as practicable to review the decision. The board may affirm or
2modify the designee's decision.
SB743,2 3Section 2. 450.02 (3r) of the statutes is created to read:
SB743,2,64 450.02 (3r) The board or its designee may grant a waiver or variance under this
5subsection from a rule promulgated by the board, or authorize a pilot program, if all
6of the following are true:
SB743,2,87 (a) The waiver, variance, or pilot program is related to the practice of pharmacy
8or prescription verification.
SB743,2,119 (b) The board or its designee determines that the waiver, variance, or pilot
10program will improve the safety, quality, or efficiency of the practice of pharmacy in
11this state.
