AB842,1,4 1An Act to amend 20.435 (1) (q); and to create 20.285 (1) (sr), 20.370 (4) (as),
220.370 (4) (ax), 20.370 (4) (ay), 20.370 (4) (az) and 20.370 (6) (es) of the statutes;
3relating to: providing funding related to PFAS programs and positions,
4granting rule-making authority, and making an appropriation.

This bill provides funding and positions for the provisions in 2019 Assembly Bill
.... (LRB-5532), relating to perfluoroalkyl and polyfluoroalkyl substances (PFAS)
regulation.
The bill provides $250,000 as a onetime appropriation from the environmental
fund for the University of Wisconsin Board of Regents to provide a grant to a campus
to research technologies for destroying PFAS.
The bill also provides $1,000,000 as a onetime appropriation from the
environmental fund for the Department of Natural Resources to test for PFAS in
noncommunity water systems that may be in proximity to PFAS contamination and
in municipal public water supply systems.
In addition, the bill provides $150,000 biennially from the environmental fund
for DNR to sample and test the environment, wildlife, facilities, and other sites for
PFAS.
The bill provides, as a onetime appropriation, $120,000 from the environmental
fund for DNR to investigate emerging PFAS and to provide temporary potable water
or treatment systems when no responsible party for contamination is available.

The bill also provides $5,000,000 biennially from the environmental fund for
the PFAS municipal grant program created under 2019 Assembly Bill ....
(LRB-5532).
In addition, the bill expands the purpose of an existing appropriation to the
Department of Health Services so that it may be used to fund the blood testing
program and cancer cluster study required under 2019 Assembly Bill ....
(LRB-5532).
The bill also creates a new appropriation for the settlement funds collected and
deposited into the PFAS action fund created under 2019 Assembly Bill ....
(LRB-5532) so that the funds may be used for the purposes for which they are
received.
Finally, the bill provides funding for the two new DHS positions created under
2019 Assembly Bill .... (LRB-5532).

AB842,2 1Section 2 . 20.285 (1) (sr) of the statutes is created to read:
AB842,3,42 20.285 (1) (sr) PFAS disposal research grant. From the environmental fund,
3as a continuing appropriation, the amounts in the schedule to provide the grant
4under s. 36.50.
AB842,3 5Section 3 . 20.370 (4) (as) of the statutes is created to read:
AB842,3,116 20.370 (4) (as) PFAS drinking water sampling. From the environmental
7fund, as a continuing appropriation, the amounts in the schedule for testing water
8samples for the presence of perfluoroalkyl or polyfluoroalkyl substances in
9noncommunity water systems that may be in proximity to perfluoroalkyl or
10polyfluoroalkyl substances contamination and in municipal public water supply
11systems, as defined by the department by rule.

14the amounts in the schedule for sampling and testing the environment, wildlife,
15facilities, and other sites for perfluoroalkyl and polyfluoroalkyl substances.
AB842,5 16Section 5 . 20.370 (4) (ay) of the statutes is created to read:
AB842,4,317 20.370 (4) (ay) PFAS investigation and assistance. From the environmental
18fund, as a continuing appropriation, the amounts in the schedule for investigating

1emerging contaminants that are perfluoroalkyl or polyfluoroalkyl substances and
2providing temporary potable water or treatment systems when no responsible party
3for contamination is available.
AB842,6 4Section 6 . 20.370 (4) (az) of the statutes is created to read:
AB842,4,75 20.370 (4) (az) PFAS settlement funds. From the PFAS action fund, all
6moneys described under s. 25.461 to carry out the purposes for which they are
7received.
AB842,7 8Section 7 . 20.370 (6) (es) of the statutes is created to read:
AB842,4,119 20.370 (6) (es) Environmental aids PFAS municipal grant program.
10Biennially, from the environmental fund, the amounts in the schedule for the PFAS
11municipal grant program under s. 292.66.
AB842,8 12Section 8 . 20.435 (1) (q) of the statutes is amended to read:
AB842,4,1813 20.435 (1) (q) Groundwater and air quality standards. From the
14environmental fund, the amounts in the schedule to develop groundwater standards
15and implement ch. 160 and, to assist in the development of emission standards for
16hazardous air contaminants under s. 46.34, to conduct blood testing under s. 254.25,
17and to conduct the study under 2019 Wisconsin Act .... (2019 Assembly Bill ....

AB842,4,2120 (1) Reconciliation provision. This act is void if 2019 Assembly Bill ....
21(LRB-5532) is not enacted.
AB842,10 22Section 10 . Fiscal change.
AB842,5,1023 (1) Position authorizations; health services. In the schedule under s. 20.005
24(3) for the appropriation to the department of health services under s. 20.435 (1) (a),
25the dollar amount for fiscal year 2019-20 is increased by $17,500 to fund the increase

1of the authorized FTE advanced toxicologist project position for the department
2under 2019 Assembly Bill .... (LRB-5532) and by $20,500 to fund increase of the
3authorized FTE research scientist project position for the department under 2019
4Assembly Bill .... (LRB-5532). In the schedule under s. 20.005 (3) for the
5appropriation to the department of health services under s. 20.435 (1) (a), the dollar
6amount for fiscal year 2020-21 is increased by $70,000 to fund the increase of the
7authorized FTE advanced toxicologist project position for the department under
82019 Assembly Bill .... (LRB-5532) and by $81,900 to fund the increase of the
9authorized FTE research scientist project position for the department under 2019
