AB224,1,3 An Act to renumber and amend 60.30 (4) (a); to amend 17.03 (10), 59.10 (2) (b) and 59.10 (3) (d); and to create 60.30 (4) (a) 2., 61.23 (3) and 62.09 (5) (f) of the statutes; relating to: terms of office for local government officers.

Analysis by the Legislative Reference Bureau

Under current law, the term of office for county board supervisor or town board supervisor is two years and the term of office for most city or village elected officers is two years. This bill provides that the terms of office for these officers extends until the successors are elected and qualified.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB224,1 Section 1. 17.03 (10) of the statutes is amended to read:

AB224,1,8 17.03 (10) If the office is elective, the incumbent's term expires, except for the office of sheriff, coroner, register of deeds or , district attorney, county board supervisor, or town board supervisor or a village officer to whom s. 61.23 (3) applies or a city officer to whom s. 62.09 (5) (f) applies.

AB224,2 Section 2. 59.10 (2) (b) of the statutes is amended to read:

AB224,2,10 59.10 (2) (b) Election; term. For an election that is held before 2016, supervisors shall be elected for 4-year terms at the election to be held on the first Tuesday in April next preceding the expiration of their respective terms, and shall take office on the 3rd Monday in April following their election. For an election that is held in 2016 and thereafter, supervisors Supervisors shall be elected for 2-year terms at the election to be held on the first Tuesday in April next preceding the expiration of their respective terms, and shall take office on the 3rd Monday in April following their election. The term of office of a supervisor is 2 years and until a successor is elected and qualified.

AB224,3 Section 3. 59.10 (3) (d) of the statutes is amended to read:

AB224,2,16 59.10 (3) (d) Election and term of supervisors. Supervisors are county officers, . Supervisors shall be elected for 2-year terms at the election to be held on the first Tuesday in April in even-numbered years and shall take office on the 3rd Tuesday in April of that year. The term of office of a supervisor is 2 years and until a successor is elected and qualified.

AB224,4 Section 4. 60.30 (4) (a) of the statutes is renumbered 60.30 (4) (a) 1. and amended to read:

AB224,2,20 60.30 (4) (a) 1. Every Except as provided under subd. 2., the term of office of an elected town officer shall hold the office for is 2 years.

AB224,5 Section 5. 60.30 (4) (a) 2. of the statutes is created to read:

AB224,2,23 60.30 (4) (a) 2. The term of office of a town board supervisor is 2 years and until a successor is elected and qualified.

AB224,6 Section 6. 61.23 (3) of the statutes is created to read:

AB224,3,2 61.23 (3) A person serving in elective office shall serve until his or her term expires and a successor is elected and qualified.

AB224,7 Section 7. 62.09 (5) (f) of the statutes is created to read:

AB224,3,5 62.09 (5) (f) A person serving in elective office shall serve until his or her term expires and a successor is elected and qualified.
