ASSEMBLY AMENDMENT 4, TO 2009 SENATE BILL 434

SB434-AA4,1,2 At the locations indicated, amend the bill, as shown by senate substitute amendment 1, as follows:

SB434-AA4,1,5 1. Page 1, line 2: after "milk," insert "financial assistance to local health departments for responding to outbreaks of illness associated with the consumption of unpasteurized milk,".

SB434-AA4,1,6 2. Page 1, line 3: delete "and".

SB434-AA4,1,7 3. Page 1, line 4: after "rules" insert ", and making an appropriation".

SB434-AA4,1,8 4. Page 2, line 1: before that line insert:

SB434-AA4,1,9 " Section 1b. 20.115 (1) (gb) of the statutes is amended to read:

SB434-AA4,2,2 20.115 (1) (gb) Food regulation. The amounts in the schedule for the regulation of food under chs. 93, 97 and 98.All moneys received under ss. 93.06 (1r) and (1w), 93.09, 93.11, 93.12, 97.17, 97.175, 97.20, 97.21, 97.22, 97.24 (2) and (3) to (8), 97.27, 97.29, 97.30 (3) (a), (b) and (c), 97.41, 98.145 and 98.146 for the regulation of food shall be credited to this appropriation.

SB434-AA4, s. 1c Section 1c. 20.115 (1) (t) of the statutes is created to read:

SB434-AA4,2,6 20.115 (1) (t) Unpasteurized milk regulation. From the unpasteurized milk public health fund, 25 percent of the moneys received under s. 97.24 (2g) (be) for administering s. 97.24 (2g).

SB434-AA4, s. 1d Section 1d. 20.435 (1) (r) of the statutes is created to read:

SB434-AA4,2,11 20.435 (1) (r) Unpasteurized milk public health local assistance. From the unpasteurized milk public health fund, 75 percent of the moneys received under s. 97.24 (2g) (be) for financial assistance to local health departments under s. 250.04 (15).

SB434-AA4, s. 1g Section 1g. 25.17 (1) (xLm) of the statutes is created to read:

SB434-AA4,2,13 25.17 (1) (xLm) Unpasteurized milk public health fund (s. 25.55).

SB434-AA4, s. 1j Section 1j. 25.55 of the statutes is created to read:

SB434-AA4,2,17 25.55 Unpasteurized milk public health fund. There is established a separate nonlapsible trust fund designated as the unpasteurized milk public health fund consisting of all moneys received under s. 97.24 (2r) (be).".

SB434-AA4,2,18 5. Page 2, line 1: delete " Section 1" and substitute "Section 1s".

SB434-AA4,2,19 6. Page 3, line 24: after that line insert:

SB434-AA4,2,23 "(be) For each sale of unpasteurized milk for human consumption, collect a public health safety fee from the purchaser at the rate of $1 per quart, and each month pay to the department the total amount of public health safety fees collected during the previous month.".

SB434-AA4,2,25 " Section 2m. 250.04 (15) of the statutes is created to read:

SB434-AA4,3,5 250.04 (15) From the appropriation under s. 20.435 (1) (r), the department shall provide financial assistance to local health departments for the costs incurred in responding to outbreaks of illness associated with the consumption of unpasteurized milk.".
