22(1vt) Passive review. Notwithstanding sections 13.101 (3) (a) and 20.865 (4) (u)
23of the statutes, if the technology for educational achievement in Wisconsin board
24submits a request to the joint committee on finance to supplement the appropriation
1under section 20.275 (1) (s), (t) or (tm) of the statutes, as affected by this act, and
2submits information related to the board's estimated program demand and final,
3annualized costs to the committee, and if the cochairpersons of the joint committee
4on finance do not notify the board within 14 working days after the date of the board's
5request and submittal of information that the committee has scheduled a meeting
6to review the request and information, the request is considered approved. If, within
714 working days after the submission of the request and information, the
8cochairpersons of the committee notify the board that the committee has scheduled
9a meeting to review the request, the request may be granted only upon approval of
10the committee.

11(1w) Projections and funding for 2001-03 biennial budget. Notwithstanding
12section 16.42 (1) of the statutes, in submitting information under section 16.42 of the
13statutes for the purposes of the 2001-03 biennial budget, the technology for
14educational achievement in Wisconsin board shall include information concerning
15all of the following:

16(a) Projections concerning the ultimate size of the educational
17telecommunications access program.

18(b) How much of the funding required for the educational telecommunications
19access program should be drawn from universal service fund assessments.

20(c) Other funding sources if the recommended funding from the universal
21service fund is less than the total projected costs for the educational

23(d) How long entities participating in the educational telecommunications
24access program should continue to receive subsidies under the program and how best
25to phase out the program.

1(2x) Rules relating to educational technology training grants.

2(a) Subject to paragraph (b), the technology for educational achievement in
3Wisconsin board shall use the procedure under section 227.24 of the statutes to
4promulgate the rules required under section 44.72 (1) (d) of the statutes, as created
5by this act, for a period not to exceed the period authorized under section 227.24 (1)
6(c) and (2) of the statutes. Notwithstanding section 227.24 (1) (a), (2) (b) and (3) of
7the statutes, the board need not provide evidence of the necessity of preserving the
8public peace, health, safety or welfare in promulgating the rules under this
9paragraph.

10(b) The board shall submit the proposed rules under paragraph (a) to the
11cochairpersons of the joint committee on information policy. If the cochairpersons of
12the committee do not notify the board that the committee has scheduled a meeting
13for the purpose of reviewing the proposed rules within 14 working days after the date
14of the board's submittal, the board may proceed to promulgate the rules. If, within
1514 working days after the date of the board's submittal, the cochairpersons of the
16committee notify the board that the committee has scheduled a meeting for the
17purpose of reviewing the proposed rules, the board shall not promulgate the rules
18until the committee approves the rules.

20(1to) Grant for upgrade of Aztalan State Park. From the appropriation under
21section 20.380 (1) (kg) of the statutes, as created by this act, the department of
22tourism shall make a grant of $75,000 in fiscal year 1999-2000 to the department
23of natural resources for the purpose of completing the upgrading of Aztalan State
24Park, including the development of an overall public education and research
25strategy, as well as a long-term interpretive and management plan that includes
1establishing an interpretive visitor's center, opening other portions of the site to the
2public and using visual effects to enhance the experience of visitors to the park. The
3state historical society shall work with management personnel of Aztalan State Park
4to facilitate timely completion of the upgrade. The department of natural resources
5shall deposit the grant proceeds in the appropriation account under section 20.370
6(1) (mk) of the statutes.

Richard I. Bong air museum. Of the amounts appropriated to the
9department of transportation under section 20.395 (2) (nx) of the statutes, the
10department shall award a grant of $1,000,000 in fiscal year 1999-2000 to the city of
11Superior for the purpose of constructing the Richard I. Bong air museum in Superior,
12except that the amount of the grant awarded under this subsection may not exceed
1380% of the costs of constructing the air museum.

14(2c) Entitlement to supplements for unbudgeted compensation adjustments. 15Notwithstanding section 20.928 of the statutes, the department of transportation is
16not entitled to any supplements for unbudgeted compensation adjustments under
17section 20.928 of the statutes for the 1999-2001 fiscal biennium for any position
18funded from the appropriation under section 20.395 (3) (bq) of the statutes, except
19for any supplement that exceeds an adjustment increase for that position above the
20level established for fiscal year 1998-99 of 5.8% in fiscal year 1999-2000 and 6.1%
21in fiscal year 2000-01, as determined by the secretary of administration, and for any
22position funded from the appropriation under section 20.395 (3) (cq) of the statutes,
23as affected by this act, except for any supplement that exceeds an adjustment
24increase for that position above the level established for fiscal year 1998-99 of 2.5%
1in fiscal year 1999-2000 and 3% in fiscal year 2000-01, as determined by the
2secretary of administration.

3(2g) Flambeau River Recreational Bridge project. Of the amounts
4appropriated to the department of transportation under section 20.395 (2) (nx) of the
5statutes, the department shall allocate $190,400 in the 1999-2001 fiscal biennium
6to the city of Park Falls for the Flambeau River Recreational Bridge project.

7(2h) Little Lake Butte des Morts Trestle Trail Causeway project. Of the
8amounts appropriated to the department of transportation under section 20.395 (2)
9(nx) of the statutes, the department shall allocate $80,000 in the 1999-2001 fiscal
10biennium to the city of Menasha for the Little Lake Butte des Morts Trestle Trail
11Causeway project, except that the amount allocated under this subsection may not
12exceed 50% of the costs of the project.

Milwaukee lakeshore bicycle and pedestrian facilities grants. The
14department of transportation shall award grants from the appropriation under
15section 20.395 (2) (ny) of the statutes, as created by this act, to the department of
16natural resources for the purpose of constructing pedestrian and bicycle facilities
17along Lake Michigan in the city of Milwaukee.

18(3g) Kinnickinnic River Bike Trail project. Notwithstanding section 85.245
19(1) of the statutes, before approving any other project to receive federal funds
20distributed under section 85.245 of the statutes, the secretary of transportation shall
21approve the Kinnickinnic River Bike Trail project in the city of Milwaukee to receive
22federal funds distributed under section 85.245 of the statutes if the project is
23consistent with the requirements of
23 USC 149 and regulations promulgated under
2423 USC 149.

1(3m) Annual outdoor advertising sign permit fee. If the department of
2transportation establishes an annual fee under section 84.30 (10m) of the statutes,
3as created by this act, during the 1999-2001 fiscal biennium, the department shall
4design the fee to collect not more than $510,000 in fiscal year 2000-01.

5(3v) Proposals for transportation planning, access and infrastructure
6improvements. Notwithstanding section 16.42 (1) of the statutes, the department of
7transportation shall work with the city of Green Bay, the city of La Crosse, the city
8of Milwaukee and the city of Oshkosh to develop proposals for transportation
9planning, access and infrastructure improvements for inclusion in the department's
10submission under section 16.42 of the statutes for the purposes of the 2001-03
11biennial budget act.

12(5xy) Transfer of authority and records from the department of
13transportation to the department of commerce. On July 1, 2000, all of the following
14apply:

15(a) All equipment, supplies and records of the department of transportation
16pertaining to mobile homes that exceed the statutory size under section 348.07 (2)
17of the statutes are transferred to the department of commerce.

18(b) All rules pertaining to mobile homes that exceed the statutory size under
19section 348.07 (2) of the statutes that have been promulgated by the department of
20transportation, that are in effect on July 1, 2000, and that do not conflict with the
21rules of the department of commerce shall become rules of the department of
22commerce and shall remain in effect until their specified expiration dates or until
23amended or repealed by the department of commerce. All orders pertaining to mobile
24homes that exceed the statutory size under section 348.07 (2) of the statutes that
25have been issued by the department of transportation, that are in effect on July 1,
12000, and that do not conflict with orders of the department of commerce shall
2become orders of the department of commerce and shall remain in effect until their
3specified expiration dates or until modified or rescinded by the department of
4commerce.

5(c) Any matter relating to mobile homes that exceed the statutory size under
6section 348.07 (2) of the statutes that is pending with the department of
7transportation on July 1, 2000, is transferred to the department of commerce, and
8all materials submitted to or actions taken by the department of transportation with
9respect to the pending matter are considered to have been submitted to or taken by
10the department of commerce.

11(d) The department of commerce may collect any amount payable under the
12statutes before July 1, 2000, for the costs of materials, activities or services that were
13provided by the department of transportation and that relate to mobile homes that
14exceed the statutory size under section 348.07 (2) of the statutes.

15(e) Any person who, on the first day of the 6th month beginning after the
16effective date of this paragraph, has been issued a license by the department of
17transportation to sell mobile homes that exceed the statutory size under section
18348.07 (2) of the statutes is considered to have received that license under section
19101.951 or 101.952 of the statutes, as created by this act, whichever is appropriate.

Radio services positions. The authorized FTE positions for the department
21of transportation are increased by 7.0 SEG positions, to be funded from the
22appropriation under section 20.395 (5) (dq) of the statutes, as affected by this act, for
23the performance of duties primarily related to radio services.

24(7c) Hartford Heritage Auto Museum. Notwithstanding section 86.91 (1) of
25the statutes, as affected by this act, the department of transportation shall erect
1directional signs along USH 41 near the interchange with STH 60 for the Hartford
2Heritage Auto Museum located in Hartford in Washington County. The department
3may not charge any fee related to signs erected under this subsection.

4(7d) Airport perimeter fencing. Notwithstanding section 114.34 (1) and (3)
5of the statutes, the department of transportation shall provide a 20% match to any
6federal funds received during the 1999-2001 fiscal biennium for the construction of
7airport perimeter fencing.
