Public Defender
On May 9, 2024, the State of Wisconsin State Public Defender Board (SPD) submitted a proposed rulemaking order to the Wisconsin Legislative Council Rules Clearinghouse.
The scope statement for this rule, SS 038-22, was approved by the Governor on April, 21, 2022, published in Register No. 797A on May 9, 2022, and approved by the SPD as required by s. 227.135(2), Stats., on June 24, 2022. Analysis
The State of Wisconsin Public Defender Board (SPD) proposes an order to amend PD 1.05(2), 4.02(2), and 4.03(1)(c); and to create PD 1.05(3m), (5m), (5r), and (7m) and PD 4.02(2) and PD 4.03(5m), (5r), and (7m) relating to the state public defender and the state public defender Board’s authority to review appeals to agency actions regarding private bar certification and bill payment. These rule changes are designed to provide clarity to private bar attorneys who accept State Public Defender cases.
Agency Procedure for Promulgation
A public hearing is required under s. 227.16 (1), Wis. Stats., and will held on June 24, 2024 at 10:00 A.M. The Wisconsin State Public Defender is responsible for preparing the rule. Agency Contact Person
