to any public or private entity unless at least one of the following applies:
1. The person does not offer, resell, or provide telecommunications services that
it did not offer, resell, or provide on June 15, 2011, and the person does not offer,

a university-affiliated research facility or a facility approved by the Joint Committee
on Finance that the person was not serving on June 15, 2011.
