Goyke, Ohnstad, Wright, Billings, Kahl, Danou, Zepnick, Hesselbein,
Kessler and Riemer.
At the locations indicated, amend the bill
, as shown by senate substitute 2
amendment 2, as follows:
53. Page 107, line 23
: delete the material beginning with "unless" and ending 6
with "application." on page 108, line 6, and substitute "except as provided under pars. 7
(ae) to (as).
(ae) The department may extend the deadline under par. (a), upon notice to the 9
applicant, for a total of not more than 180 days, if any of the following applies:
1. The department needs additional time to ensure collaboration with any 11
federal regulatory agency with responsibilities related to the mining operation.
2. The department needs additional time to evaluate information related to the 2
mining operation that becomes available after the applicant files the application for 3
the mining permit.
3. The applicant makes changes to its proposal for the mining operation.
(am) The applicant may, by providing notice to the department, extend the 6
deadline under par. (a) as often and for any length of time that the applicant 7
determines to be necessary.
(as) The department and an applicant may negotiate an agreement specifying 9
a timeline for processing the application for a mining permit and for other approvals, 10
licenses, or permits issued by the department and that timeline may include a 11
deadline for the department to approve or deny the application for a mining permit 12
that is different from the deadline under par. (a).".
