Analysis by the Legislative Reference Bureau
Under current law, unless a specific exception applies, pupil records
maintained in a public school are confidential. The definition of a record includes
material on which written, drawn, printed, spoken, visual, or electromagnetic
information is recorded or preserved. This bill creates a specific exception to the
requirement that pupil records be kept confidential for safety camera footage that
is made available to a law enforcement agency if sharing that footage serves a
legitimate safety interest.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
118.125 (2) (dm) of the statutes is created to read:
(dm) Safety camera footage may be made available to a law 5
enforcement agency to the extent the school board determines sharing the footage 6
with the law enforcement agency serves a legitimate safety interest.
