ASSEMBLY SUBSTITUTE AMENDMENT 1,
To 1995 ASSEMBLY BILL 112

AB112-ASA1,1,4 1An Act to repeal 165.83 (2) (a) 3.; to renumber and amend 165.83 (2) (b); and
2to amend 165.83 (2) (a) 2., 165.83 (2) (g) and 165.83 (2) (h) of the statutes;
3relating to: obtaining fingerprints and other information from persons who
4are arrested or taken into custody.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB112-ASA1, s. 1 5Section 1. 165.83 (2) (a) 2. of the statutes is amended to read:
AB112-ASA1,1,126 165.83 (2) (a) 2. For an offense which that is a misdemeanor under ch. 161, 940,
7941 or 948, a misdemeanor arising out of an arrest for a domestic abuse incident
8under s. 968.075, a violation of s. 813.12 (8) (a),
or a violation of an ordinance
9involving burglary tools, commercial gambling, dealing in gambling devices,
10contributing to the delinquency of a child, dealing in stolen property, controlled
11substances under ch. 161, firearms, dangerous weapons, explosives, pandering,
12prostitution, sex offenses where children are victims, or worthless checks.
AB112-ASA1, s. 2 13Section 2. 165.83 (2) (a) 3. of the statutes is repealed.
AB112-ASA1, s. 3
1Section 3. 165.83 (2) (b) of the statutes is renumbered 165.83 (3) and amended
2to read:
AB112-ASA1,2,63 165.83 (3) Accept The department may accept for filing, and may keep on file
4or in a data base,
fingerprints and other identifying data, taken at the discretion of
5the law enforcement or tribal law enforcement agency involved, on persons arrested
6or taken into custody for offenses other than those listed in par. sub. (2) (a).
AB112-ASA1, s. 4 7Section 4. 165.83 (2) (g) of the statutes is amended to read:
AB112-ASA1,2,108 165.83 (2) (g) Furnish all reporting officials with forms and instructions which
9specify in detail the nature of the information required under pars. (a) to (f) and sub.
10(3)
and any other matters which facilitate collection.
AB112-ASA1, s. 5 11Section 5. 165.83 (2) (h) of the statutes is amended to read:
AB112-ASA1,2,1512 165.83 (2) (h) Cooperate with and assist all law enforcement and tribal law
13enforcement agencies in the state in the establishment of a state system of criminal
14identification and in obtaining fingerprints and other identifying data on all persons
15described in pars. (a), (b) and (c) and sub. (3).
AB112-ASA1, s. 6 16Section 6. Initial applicability.
AB112-ASA1,2,1817 (1)  This act first applies to fingerprints and other identifying data obtained
18from persons arrested or taken into custody on the effective date of this subsection.
