AB280-ASA1,1,4 1An Act to renumber 448.51; to amend 448.52 (intro.); and to create 446.02
2(10), 448.51 (2) and 448.525 of the statutes; relating to: persons who may claim
3to render physical therapy or physiotherapy services and granting
4rule-making authority.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB280-ASA1, s. 1 5Section 1. 446.02 (10) of the statutes is created to read:
AB280-ASA1,1,106 446.02 (10) (a) The examining board and the physical therapists affiliated
7credentialing board acting under s. 448.525 shall jointly promulgate rules that
8establish the circumstances under which and the extent to which a chiropractor
9licensed under this chapter may claim to render physical therapy or physiotherapy
10services within the scope of the practice of chiropractic.
AB280-ASA1,1,1411 (b) The examining board may promulgate rules relating to the circumstances
12under which and the extent to which a chiropractor licensed under this chapter may
13claim to render physical therapy or physiotherapy services within the scope of the
14practice of chiropractic only as provided under par. (a).

1Section 2. 448.51 of the statutes is renumbered 448.51 (1).
AB280-ASA1, s. 3 2Section 3. 448.51 (2) of the statutes is created to read:
AB280-ASA1,2,53 448.51 (2) (a) In this subsection, "advertisement" includes advertisements that
4appear on outdoor signs, in print or electronic media, and in material mailed to a
5person other than a patient or prospective patient who has requested the material.
AB280-ASA1,2,86 (b) Except as provided in par. (c), no person may claim to render physical
7therapy or physiotherapy services unless the person is licensed under this
8subchapter.
AB280-ASA1,2,109 (c) A chiropractor licensed under ch. 446 may claim to render physical therapy
10or physiotherapy services only as follows:
AB280-ASA1,2,1111 1. In accordance with the rules promulgated under ss. 446.02 (10) and 448.525.
AB280-ASA1,2,1312 2. If the rules under ss. 446.02 (10) and 448.525 have not taken effect, as
13follows:
AB280-ASA1,2,1814 a. If, anytime before October 17, 1995, the chiropractor claimed in an
15advertisement to render physical therapy or physiotherapy services, the
16chiropractor may continue to claim to render physical therapy or physiotherapy
17services in an advertisement until the rules promulgated under ss. 446.02 (10) and
18448.525 take effect.
AB280-ASA1,2,2319 b. The chiropractor may claim to render physical therapy or physiotherapy
20services in private communications with an individual who is a patient or
21prospective patient until the rules promulgated under ss. 446.02 (10) and 448.525
22take effect. This subd. 2. b. also applies to an employe or agent of the chiropractor
23who claims that the chiropractor renders physical therapy or physiotherapy services.
AB280-ASA1, s. 4 24Section 4. 448.52 (intro.) of the statutes is amended to read:

1448.52Applicability. (intro.) This subchapter does not require a license
2under this subchapter for any of the following, if the person does not claim to render
3physical therapy or physiotherapy services as prohibited under s. 448.51 (2) (b)

AB280-ASA1, s. 5 4Section 5. 448.525 of the statutes is created to read:
AB280-ASA1,3,10 5448.525 Rules concerning claims to render physical therapy or
6physiotherapy services.
(1) The affiliated credentialing board and the
7chiropractic examining board acting under s. 446.02 (10) shall jointly promulgate
8rules that establish the circumstances under which and the extent to which a
9chiropractor licensed under ch. 446 may claim to render physical therapy or
10physiotherapy services within the scope of the practice of chiropractic.
AB280-ASA1,3,14 11(2) The affiliated credentialing board may promulgate rules relating to the
12circumstances under which and the extent to which a chiropractor licensed under
13this chapter may claim to render physical therapy or physiotherapy services within
14the scope of the practice of chiropractic only as provided under sub. (1).
