AB299-ASA1,1,3 1An Act to create 446.02 (7m) and 632.875 of the statutes; relating to:
2independent evaluations of chiropractic treatment that are conducted for
3insurers and granting rule-making authority.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB299-ASA1, s. 1 4Section 1. 446.02 (7m) of the statutes is created to read:
AB299-ASA1,1,85 446.02 (7m) (a) A chiropractor shall create and maintain a patient record for
6every patient the chiropractor examines or treats. A patient record created and
7maintained under this paragraph shall contain complete and comprehensive
8healthcare information, as defined by the examining board by rule.
AB299-ASA1,1,129 (b) A chiropractor shall preserve a patient record created and maintained
10under par. (a) for at least 3 years after the chiropractor makes his or her last entry
11or notation in the patient record or for any longer period that is otherwise required
12by law.
AB299-ASA1, s. 2 13Section 2. 632.875 of the statutes is created to read:

1632.875 Independent evaluations relating to chiropractic treatment.
2(1) In this section:
AB299-ASA1,2,43 (a) "Chiropractor" means a person licensed to practice chiropractic under ch.
4446.
AB299-ASA1,2,75 (b) "Independent evaluation" means an examination or evaluation by or
6recommendation of a chiropractor or a peer review committee under s. 632.87 (3) (b)
71.
AB299-ASA1,2,98 (c) "Patient" means a person whose treatment by a chiropractor is the subject
9of an independent evaluation.
AB299-ASA1,2,1110 (d) "Treating chiropractor" means a chiropractor who is treating a patient and
11whose treatment of the patient is the subject of an independent evaluation.
AB299-ASA1,2,17 12(2) If, on the basis of an independent evaluation, an insurer restricts or
13terminates a patient's coverage for the treatment of a condition or complaint by a
14chiropractor acting within the scope of his or her license and the restriction or
15termination of coverage results in the patient becoming liable for payment for his or
16her treatment, the insurer shall provide to the patient and to the treating
17chiropractor a written statement that contains all of the following:

19632.87 (3) (b) 1.
AB299-ASA1,2,2020 (b) The name of the treating chiropractor.
AB299-ASA1,2,2121 (c) The name of the patient.
AB299-ASA1,2,2322 (d) A description of the insurer's internal appeal process that is available to the
23patient.

1(e) A statement indicating that the patient may, no later than 30 days after
2receiving the statement required under this subsection, request an internal appeal
3of the insurer's restriction or termination of coverage.
AB299-ASA1,3,44 (f) The address to which the patient should send the request for an appeal.
AB299-ASA1,3,75 (g) A reasonable explanation of the factual basis and of the basis in the policy,
6plan or contract or in applicable law for the insurer's restriction or termination of
7coverage.
AB299-ASA1,3,98 (h) A list of records and documents reviewed as part of the independent
9evaluation.
AB299-ASA1,3,14 10(3) (a) In this subsection, "claim" means a patient's claim for coverage, under
11a policy, plan or contract covering diagnosis and treatment of a condition or
12complaint by a licensed chiropractor within the scope of the chiropractor's
13professional license, the restriction or termination of which coverage is the subject
14of an independent evaluation.
AB299-ASA1,3,1715 (b) A chiropractor who conducts an independent evaluation may not be
16compensated by an insurer based on a percentage of the dollar amount by which a
17claim is reduced as a result of the independent evaluation.
AB299-ASA1,3,20 18(4) Subject to sub. (2) (e), an insurer shall make available to a patient an
19internal procedure by which the patient may appeal an insurer's decision to restrict
20or terminate coverage.
AB299-ASA1,3,21 21(5) This section does not apply to any of the following:
AB299-ASA1,3,2222 (a) Worker's compensation insurance.
AB299-ASA1,3,2523 (b) Any line of property and casualty insurance except disability insurance. In
24this paragraph, "disability insurance" does not include uninsured motorist coverage,
25underinsured motorist coverage or medical payment coverage.

1Section 3. Nonstatutory provisions; chiropractic examining board.
AB299-ASA1,4,6 2(1)  Rules concerning patient records. The chiropractic examining board
3shall submit proposed rules required under section 446.02 (7m) of the statutes, as
4created by this act, to the legislative council staff for review under section 227.15 (1)
5of the statutes no later than the first day of the 13th month beginning after the
6effective date of this subsection.
