AB325-ASA1,1,4 1An Act to renumber and amend 655.005 (2); to amend 180.1901 (1m) (b) and
2448.08 (4); and to create 180.1901 (1m) (am), 180.1901 (1m) (bg), 180.1901 (1m)
3(br), 180.1901 (1m) (g) and 655.005 (2) (b) of the statutes; relating to: health
4care professional service corporations.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB325-ASA1, s. 1 5Section 1. 180.1901 (1m) (am) of the statutes is created to read:
AB325-ASA1,1,66 180.1901 (1m) (am) Chiropractic examining board under ch. 446.
AB325-ASA1, s. 2 7Section 2. 180.1901 (1m) (b) of the statutes is amended to read:
AB325-ASA1,1,88 180.1901 (1m) (b) Medical examining board under subch. II of ch. 448.
AB325-ASA1, s. 3 9Section 3. 180.1901 (1m) (bg) of the statutes is created to read:
AB325-ASA1,1,1110 180.1901 (1m) (bg) Physical therapists affiliated credentialing board under
11subch. III of ch. 448.
AB325-ASA1, s. 4 12Section 4. 180.1901 (1m) (br) of the statutes is created to read:
AB325-ASA1,1,1413 180.1901 (1m) (br) Dietitians affiliated credentialing board under subch. IV of
14ch. 448. This paragraph does not apply after June 30, 1999.

1Section 5. 180.1901 (1m) (g) of the statutes is created to read:

AB325-ASA1, s. 6 4Section 6. 448.08 (4) of the statutes is amended to read:
AB325-ASA1,2,145 448.08 (4) Professional partnerships and corporations permitted.
6Notwithstanding any other provision in this section, it is lawful for 2 or more
7physicians or 2 or more podiatrists, who have entered into a bona fide partnership
8for the practice of medicine or podiatry, to render a single bill for such services in the
9name of such partnership; and it also is lawful for a service corporation to render a
10single bill for services in the name of the corporation; provided that each individual
11physician or podiatrist that renders billed services and each individual licensed,
12registered or certified under subch. III or IV of this chapter or ch. 446, 449, 450, 455
13or, 457 or 459 that renders billed services is individually identified as having
14rendered such services.
AB325-ASA1, s. 7 15Section 7. 655.005 (2) of the statutes is renumbered 655.005 (2) (intro.) and
16amended to read:
AB325-ASA1,2,2117 655.005 (2) (intro.) The fund shall provide coverage, under s. 655.27, for claims
18against the health care provider or the employe of the health care provider due to the
19acts or omissions of the employe acting within the scope of his or her employment and
20providing health care services. This subsection does not apply to an employe any of
21the following:
AB325-ASA1,2,24 22(a) An employe of a health care provider if the employe is a physician or a nurse
23anesthetist or is a health care practitioner who is not providing health care services
24under the direction and supervision of a physician or nurse anesthetist.
AB325-ASA1, s. 8 25Section 8. 655.005 (2) (b) of the statutes is created to read:

1655.005 (2) (b) A service corporation organized under s. 180.1903 by health care
2professionals, as defined under s. 180.1901 (1m), if the board of governors determines
3that it is not the primary purpose of the service corporation to provide the medical
4services of physicians or nurse anesthetists. The board of governors may not
5determine under this paragraph that it is not the primary purpose of a service
6corporation to provide the medical services of physicians or nurse anesthetists unless
7more than 50% of the shareholders of the service corporation are neither physicians
8nor nurse anesthetists.
