AB478-ASA1,1,2 1An Act to create 448.25 of the statutes; relating to: departure from generally
2approved treatment by a physician.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB478-ASA1, s. 1 3Section 1. 448.25 of the statutes is created to read:
AB478-ASA1,1,8 4448.25 Departure from generally approved treatment. A physician may,
5as part of his or her practice of medicine and surgery, depart from generally approved
6procedures or generally approved uses of a drug or other substance by undertaking
7a nonstandard procedure or a nonstandard use of a drug or other substance if all of
8the following apply:
AB478-ASA1,1,11 9(1) The patient being treated has been informed about treatment alternatives,
10including both generally approved procedures or uses of a drug or other substance
11and nonstandard procedures or uses of a drug or other substance.

1(2) After being informed of treatment alternatives under sub. (1), the patient
2chooses a nonstandard alternative that is supported by basic science or by significant
3clinical evidence and experience.
