AB478-ASA1,1,2 An Act to create 448.25 of the statutes; relating to: departure from generally approved treatment by a physician.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB478-ASA1, s. 1 Section 1. 448.25 of the statutes is created to read:

AB478-ASA1,1,8 448.25 Departure from generally approved treatment. A physician may, as part of his or her practice of medicine and surgery, depart from generally approved procedures or generally approved uses of a drug or other substance by undertaking a nonstandard procedure or a nonstandard use of a drug or other substance if all of the following apply:

AB478-ASA1,1,11 (1) The patient being treated has been informed about treatment alternatives, including both generally approved procedures or uses of a drug or other substance and nonstandard procedures or uses of a drug or other substance.

AB478-ASA1,2,3 (2) After being informed of treatment alternatives under sub. (1), the patient chooses a nonstandard alternative that is supported by basic science or by significant clinical evidence and experience.
