ASSEMBLY AMENDMENT 22, To ASSEMBLY SUBSTITUTE AMENDMENT 1, To 1995 ASSEMBLY BILL 557

AB557-ASA1-AA22,1,1 At the locations indicated, amend the substitute amendment as follows:

AB557-ASA1-AA22,1,3 1. Page 3, line 23: after the semicolon insert: "transportation facilities economic assistance and development aid;".

AB557-ASA1-AA22,1,4 2. Page 28, line 10: after that line insert:

AB557-ASA1-AA22,1,5 " Section 55m. 84.185 (6r) of the statutes is created to read:

AB557-ASA1-AA22,1,9 84.185 (6r) Repayment of aid. The department may not require repayment of any aid provided under this section on the basis of the number of jobs that the improvement or economic development project causes to be retained or created in this state if all of the following apply:

AB557-ASA1-AA22,1,12 (a) The formal project agreement entered into by the department, under s. Trans. 510.08, Wis. Adm. Code, relating to the improvement or economic development project was executed after December 31, 1994.

AB557-ASA1-AA22,2,2 (b) Prior to the execution of the formal project agreement, a petition signed by a number of electors at least equal to 50% of the number of electors voting in the last general election is submitted to the governing body of the political subdivision in which the improvement or economic development project is to be located requesting a referendum on any of the following:

AB557-ASA1-AA22,2,4 1. Whether the proposed improvement or economic development project should be constructed.

AB557-ASA1-AA22,2,5 2. The question specified under par. (c) 3.

AB557-ASA1-AA22,2,7 (c) The governing body, upon receiving a petition described in par. (b), does any of the following:

AB557-ASA1-AA22,2,8 1. Takes no formal action with respect to the petition.

AB557-ASA1-AA22,2,9 2. Formally denies the request for a referendum.

AB557-ASA1-AA22,2,17 3. Holds a referendum in which the ballot question is, "Shall the .... [name of the political subdivision] guaranty that .... [description of the proposed improvement or economic development project] will directly create or retain .... [number of jobs guaranteed in the jobs guaranty] jobs?", together with a statement that, if the proposed improvement or economic development project does not directly create or retain that number of jobs, the political subdivision is obligated to repay up to the full amount of the aid provided under this section. This subdivision applies only if the question is rejected by a majority of votes cast on the question at that election.".

AB557-ASA1-AA22,2,18 3. Page 88, line 21: after that line insert:

AB557-ASA1-AA22,2,21 "(9j) Transportation facilities economic assistance and development. The creation of section 84.185 (6r) of the statutes first applies to aid provided under formal agreements executed after December 31, 1994.".
