ASSEMBLY AMENDMENT 29, To ASSEMBLY SUBSTITUTE AMENDMENT 1, To 1995 ASSEMBLY BILL 557

AB557-ASA1-AA29,1,1 At the locations indicated, amend the substitute amendment as follows:

AB557-ASA1-AA29,1,3 1. Page 3, line 6: after the first semicolon insert: "priorities for the construction of major highway projects;".

AB557-ASA1-AA29,1,4 2. Page 4, line 8: before that line insert:

AB557-ASA1-AA29,1,6 " Section 1c. 13.489 (2) of the statutes is renumbered 13.489 (2) (intro.) and amended to read:

AB557-ASA1-AA29,1,10 13.489 (2) Department to report proposed projects. (intro.) The department of transportation shall report to the commission not later than September 15 of each even-numbered year and at such other times as required under s. 84.013 (6) concerning its recommendations for adjustments all of the following:

AB557-ASA1-AA29,1,11 (a) Adjustments in the major highway projects program under s. 84.013.

AB557-ASA1-AA29, s. 1e Section 1e. 13.489 (2) (b) of the statutes is created to read:

AB557-ASA1-AA29,1,14 13.489 (2) (b) Priorities for the construction of major highway projects listed under s. 84.013 (3).

AB557-ASA1-AA29, s. 1g Section 1g. 13.489 (4) (a) of the statutes is renumbered 13.489 (4) (a) (intro.) and amended to read:

AB557-ASA1-AA29,2,5 13.489 (4) (a) (intro.) All reports submitted as provided by sub. (2) shall be reviewed by the commission. The commission shall report its recommendations and priorities as follows:

AB557-ASA1-AA29,2,11 1. The commission shall report its recommendations concerning adjustments in the major highway projects program to the governor or governor-elect, the legislature and the joint committee on finance no later than December 15 of each even-numbered year or within 30 days following submission of a report under s. 84.013 (6). The commission may recommend approval, approval with modifications, or disapproval of any project.

AB557-ASA1-AA29, s. 1h Section 1h. 13.489 (4) (a) 2. of the statutes is created to read:

AB557-ASA1-AA29,2,17 13.489 (4) (a) 2. The commission shall report its priorities concerning the construction of major highway projects to the governor or governor-elect, the legislature, the joint committee on finance and the department of transportation no later than December 15 of each even-numbered year. The commission shall approve, or approve with modifications, the priorities submitted under sub. (2) (b).

AB557-ASA1-AA29, s. 1j Section 1j. 13.489 (4) (b) of the statutes is amended to read:

AB557-ASA1-AA29,2,21 13.489 (4) (b) The commission may include in the report in par. (a) 1. its designation of highway improvement projects under s. 84.013 (6m) as major highway projects.".

AB557-ASA1-AA29,2,23 4. Page 27, line 17: after that line insert:

AB557-ASA1-AA29,2,24 " Section 52m. 84.013 (2) (c) of the statutes is created to read:

AB557-ASA1-AA29,3,3 84.013 (2) (c) Beginning with the 1995-97 fiscal biennium, the department shall implement the applicable priorities approved by the transportation projects commission as provided under s. 13.489.".

AB557-ASA1-AA29,3,6 " Section 54c. 84.013 (5) of the statutes is renumbered 84.013 (5) (a) and amended to read:

AB557-ASA1-AA29,3,13 84.013 (5) (a) Commencing with the 1985-87 biennial budget bill and biennially thereafter, the department shall request adjustments to the list of major highway projects under sub. (3) as listed projects are completed, projects are approved under sub. (6) and new projects are ready for construction. The department shall submit the proposed biennial adjustments for major highway projects to the transportation projects commission under s. 13.489 (2) (a) for review and recommendation as provided under s. 13.489.

AB557-ASA1-AA29, s. 54e Section 54e. 84.013 (5) (b) of the statutes is created to read:

AB557-ASA1-AA29,3,20 84.013 (5) (b) Commencing with the 1997-99 biennial budget bill and biennially thereafter, the department shall establish its priorities for the construction of major highway projects listed under sub. (3). The department shall submit the proposed priorities for the construction of major highway projects to the transportation projects commission under s. 13.489 (2) (b) for review and approval as provided under s. 13.489.".
